In the wake of rising property taxes, food inflation, and outrageous rents, Montana’s 4th largest county, Flathead County, could be facing a lawsuit in excess of $200 Million dollars because of an error by the Flathead County Clerk & Recorders Office, headed by Debbie Pierson.

The property in question is a 500+ acre tract of land in Somers, MT and was once wholly owned by Thorco, Inc., who has been trying to re-acquire the property for over 10 years. After several protracted court battles, settlement hearings, and even a hearing in front of the Montana Banking Oversight Committee, Thorco legally received their rightful property, and the recording thereof, on May 12, 2022 with the filing of a quitclaim deed by Title Financial Specialty Services (TFSS) on behalf of Whitefish Credit Union (WCU).

The problem, and probable crime, in the Thorco case occurred 25 days after TFSS filed the quitclaim deed and release of mortgage with the Flathead County Clerk & Recorder, when WCU CEO James Kenyon filed a “Corrected Release of Mortgage,” which was recorded by Debbie Pierson’s office.

The issue with the Kenyon letter above is that James Kenton did not have power of attorney to transfer property into WCU’s name, and Debbie Pierson recorded it anyways. Afterwards, agents of WCU sold parts of the stolen property to make the recovery by Thorco laborious and costly.
To add insult to injury, the following Montana “officials” know all about the theft of Thorco’s property by Whitefish Credit Union and have either dismissed it, helped cover it up, or passed the buck.

In addition, all 3 Flathead County Commissioners were also notified of the theft of Thorco’s property, but to this point have not acted.
The ramifications of what has been outlined above is potentially devasting to every single homeowner in Flathead Valley. If James Kenyon can transfer $50 million in real property without proper legal authorization, what’s to stop him, or anyone else, from taking the property that you live in now?

As a result of the above illegal land transfer, Thorco, Inc. will most certainly be filing a lawsuit in excess of $200 Million in damages against Flathead County, if the property is not returned to the Thorco estate immediately.
