President Trump calls on Supreme Court to act
Truth Social ^ | Jun 02, 2024 | Donald J. Trump

Posted on 06/02/2024 4:55:46 PM PDT by McGruff

Donald J. Trump @realDonaldTrump

The “Sentencing” for not having done anything wrong will be, conveniently for the Fascists, 4 days before the Republican National Convention. A Radical Left Soros backed D.A., who ran on a platform of “I will get Trump,” reporting to an “Acting” Local Judge, appointed by the Democrats, who is HIGHLY CONFLICTED, will make a decision which will determine the future of our Nation? The United States Supreme Court MUST DECIDE!

Suppose some states - Texas, for example, filed a case arguing they are about to be prevented from having a fair chance to elect Donald Trump based on a city judge? Suppose a dozen states filed an election interference case?

We’ve already crossed that bridge. He’s been held hostage and they created charges that have never been used by any of the 50 states, ever.

Sorta like it was unprecedented to have Raids to get a girl’s diary.

Or like it was unprecedented for a U.S. Vice Prez to fire a Prosecutor in another country (not to mention the Billion dollars).

What, about this specific case, REMOTELY gives the USSC jurisdiction before NY appeals are done? Nothing, is what.

You are correct. Of course the True Believers will take issue with your factual statement and, in what they consider to be a thoughtful argument, will engage in ad hominem attacks.

Never Before. Never, Ever Before meet 26 Constitutional Violations and a daughter holding $100 Million for the Result.

Anyone that has ever taken a Law class knows that a defendant in a felony case is allowed, per the Constitution, to call and subpoena witnesses in their favor.

Trump was denied this by Merchan.

Case closed.

“What, about this specific case, REMOTELY gives the USSC jurisdiction before NY appeals are done?”

Any number of famous legal experts say the Supreme Court can take it up directly. Are you a famous legal expert? Should you not look them up and correct them and Trump?

I agree. My dad died in Vietnam and I spent most of my life in the military. Right now...I’m wondering why. Spent nearly half my career overseas and now...the terrorists control the government!

And to the nation because he’s a presidential candidate.

Thank you for your sacrifices.

Hold in, something could shake out in our favor.

Especially if money flows to Trump.

60+ posts, and no one is answering this question: How?

By what legal means can the USSC intervene? If there isn't one, then they can't act until it goes through the federal courts. If the Federal courts say sometime after the next President is inaugurated, then maybe Trump has a chance to push it to the USSC.

If anyone has any better idea, please post it.

But the justices are eager to take off for vacation “recess.”

The Court is, typically, in recess from some time in June until the first Monday in October.

And did they successfully avoid having to work to decide the presidential immunity case?

If Trump gets immunity it will be for official acts as President, not this.

thanx.
from your lips to God’s ear. I’m just guessing.
Not sure how Bush v. Gore would be a precedent here.
As a due process case ? equal protection (that was Bush v Gore because of the FL SCOTUS Decision to order all counties to recount undervotes - where each county had different standards.)?
I am watching the Megyn Kelly show right now from a couple of days ago and it’s a hum dinger.
Watchin & listening to these experts I still don’t have a feel how this gets into the Fed system much less
how it gets to SCOTUS in this case.

They do whatever they want in DC.

They aren’t allowed to speak about open cases - or even answer to oversight, but Comey waived that and said Trump was lying, he was not surveilled. Comey lied again.

They aren’t supposed to be able to surveil US Presidents or American citizens, so they had the British Intelligence services do it and hand it over.

They have an Emergency docket for a reason. They declare there‘s a benefit to the country, and they do it.

If Obama was arrested because a Texas Prosecutor charged him, you really believe they’re letting Obama sit In jail? And they don’t let Obama call witnesses at Trial? What do you think? It’s obvious

The question remains unanswered: by what mechanism could the SC intervene?

The only mechansm that exists. Scotus can only act in response to a petition for writ of cert, bringing the case to them. The petition would certify that the issue was finalized by the state of New York by either denying an appeal or declining to review the case. Until then, there is no finalized state action to be brought before Scotus.

Interpretations of state law would not be brought to Scotus as the highest state court is the ultimate arbiter of interpretating state law.

A prospective federal case would most likely be brought alleging violations of due process.

If I were doing lawfare, which I am not, and I could arrange things, I would have the Appellate Division slow walk it, and then I would have the NY Court of Appeals (the highest court of NY) slow walk it until after the election, and then overturn the lower courts and remand the case. The lawfare purpose of calling Trump a convicted felon until the election would be satisfied, and Scotus would never have the opportunity to say a word about the whole disgraceful process.

Regarding Bush v. Gore, that was appealed from the highest court in the state of Florida. The Trump case has not yet completed action at the trial court, and has not begun appellate action within the State.

A Truth or a Tweet is informal.

The Speaker of the House should send an official letter to the Supreme Court, and the Chief Justice will have to respond.

Senate leadership and state Governors also should send official letters.

So damn what.

This is why we HAVE a Supreme Court.

This kind of lawlessness and perversion of our courts and justice system cannot be allowed to stand.

Petition of common writs. Although rare, this is the mechanism for direct appeal to the USSC
