UVALDE, Texas— Families of children killed in the mass shooting at an elementary school here two years ago and survivors filed a lawsuit Wednesday against 91 state police officers and the local school district, calling their response the “single greatest failure of law enforcement to confront an active shooter in American history.”

Uvalde attack and failures of responding law enforcement to stop the killing shocked the nation. A gunman killed 19 fourth-graders and two teachers while nearly 400 officers from some two dozen state and federal agencies waited to intervene for more than an hour, even as children repeatedly called 911 from inside the classroom.
The suit, filed on behalf of families of 17 of the children killed and two of the surviving victims in federal court in the Western District of Texas, is against individuals because of immunity protections for state departments, those involved with the suit said. Among its claims are that the defendants violated the 14th Amendment constitutional rights of the victims and survivors.

This case epitomizes why qualified immunity should be completely done away with.

If I were her, I’d make life miserable for any involved Uvalde police officer, and on a daily basis. I’d follow them around and demand they resign. It would become my life’s work.
Anyway, all honor to the Border Patrol officers who showed up and took the gunman out.

But, WHAT have LEO “learned”?
How many of them lost their jobs, house, pension, livelihood etc?
The City, state pays out the victims. And the Police involved go to work, same as always, just another day. They have not suffered.
Indeed. QI is one of the few places where I find my opinion to be counter to justice Thomas. He is far too willing to give the police state the benefit of the doubt.
Qualified immunity protects them. Unless they knowingly violated a constitutional right clearly spelled out in case law, individual officers can’t be held liable.

The Supreme Court has ruled police have no obligation to protect you. They can walk away, turn their back and let someone kill you and they are in no way liable.

I’m actually in favor of qualified immunity when a cop has to make a snap decision while under pressure. It should be abolished otherwise.
So if a cop casually decides to do the wrong thing (no time pressure), his qualified immunity should be gone.
In the Uvalde case, suppose a cop hears gunfire and he retreats to assess the situation. Qualified immunity. But then he stays outside and does nothing while children are being slaughtered. No qualified immunity. He should be open to a personal lawsuit.
Should such a lawsuit should be successful? That’s a whole other discussion.

They did. They violated the right to LIFE, liberty,and the pursuit of happiness. They are all chicken sh!t.
