Rachael Rollins suspended from practicing law in Massachusetts

Rollins resigned as the state’s top federal prosecutor last year..

Disgraced former U.S. Attorney Rachael Rollins has been suspended from practicing law in the Bay State.

Rollins’ law license was suspended on Feb. 20, for non-payment of registration fees, according to documents from the Supreme Judicial Court of Suffolk County, where the Massachusetts Board of Bar Overseers filed a motion for suspension.

The motion for Rollins’ suspension, among a number of other attorneys, was entered with the court on Jan. 16, and decided on Feb. 20, SJC documents show.

“Upon consideration thereof, it is decided that each attorney whose name and date of admission to the bar are listed in the amended motion is hereby suspended from the practice of law in this commonwealth,” Associate Justice Dalila Argaez Wendlandt wrote in the decision.

Wendlandt further states that the suspension became effective 14 days after the entry of the court order.

It’s unclear when Rollins let her bar license lapse or whether she intends to return to the legal profession following her decision to resign her post as the state’s top federal prosecutor last May — ahead of the release of two scathing federal reports that warned she could face disciplinary action if she did not promptly quit.

Rollins, who worked as Suffolk district attorney before leaving to join the Biden administration as the Massachusetts U.S. Attorney, was found by the Department of Justice to have attempted to influence the outcome of the Suffolk DA race in favor of former City Councilor Ricardo Arroyo, who lost the primary to Kevin Hayden.

The violation was “among other” instances of significant misconduct flagged by DOJ Inspector General Michael Horowitz in his scathing report to Congress.

Rollins did not return a phone call seeking comment on Tuesday. Her new job with Roxbury Community College, where she is being paid $96,000 to work as a part-time special projects administrator, was made public a day prior. The role is centered around the school’s new Project to Support Returning Citizens.

While Rollins absolved herself on the federal level with her resignation last May, it’s unclear whether she faces any disciplinary action from the Massachusetts Board of Bar Overseers, where a phone call seeking comment was not returned.

Rollins’ status is listed as “administrative suspension for non-registration” on the Board of Bar Overseers website, and the word “none” is listed under a section called “public discipline.”

She is no longer listed as the U.S. Attorney, and is registered under a PO Box address in Boston, according to Stephen Cronin, second assistant clerk for the Supreme Judicial Court for Suffolk County.

Cronin said Rollins has not contacted the court about reinstating her law license. To do so, she must pay a $300 fee, he said, noting that the fee is not a one-time payment and keeps accumulating for each year of suspended status.

He did not have any further insight into the status of Rollins’ law license, saying the only reason it is suspended is for non-payment. Any disciplinary action, including potential disbarment, would be handled by the Board of Bar Overseers, Cronin said, which typically keeps pending matters private.

In November 2022, the United States Department of Justice’s inspector general opened a wide-ranging ethics probe into Rollins’ appearance at a Democratic National Committee political fundraiser with First Lady Jill Biden, her travel, and use of her personal cellphone.[34]

The inspector general’s 161-page report alleged a broad array of misconduct by Rollins. It accused her of disclosing to a journalist nonpublic information about a possible Justice Department investigation, soliciting and accepting 30 free tickets to a Boston Celtics game and accepting thousands of dollars from a sports and entertainment agency for flights and a stay at a luxury resort. According to the report, Rollins tried to influence the outcome of the race to succeed her as Suffolk County District Attorney by “repeatedly attempt[ing] to sabotage” the campaign of her favored candidate’s rival. The report also found that she had lied under oath to investigators.[35][36]

Another federal watchdog agency, the U.S. Office of Special Counsel, found in its own investigative report that on multiple occasions Rollins violated the Hatch Act, a law that limits political activity by government workers. In a letter to President Joe Biden, Special Counsel Henry Kerner described Rollins’ violations as among the “most egregious transgressions” of the law that the agency has ever investigated:[37] “In particular, her repeated efforts to leak non-public DOJ information for the purpose of harming a political candidate rank among the most flagrant violations of the Hatch Act that OSC has ever investigated,” the report states. “The leak was an extraordinary breach of public trust by a senior government official, which threatens to erode confidence in the integrity of federal law enforcement actions.”[37]

Rollins resigned on May 19, 2023, preventing the federal government from disciplining her.[37][38][39][40]

Every year, bar dues are to be paid. Every year, for whatever reason, there are numerous attorneys who fail to pay their bar dues on time. Temporary suspensions are issued. The dilatory attorneys usually pay their dues and the suspensions are lifted.

In July 2021, President Joe Biden nominated Rollins to be the United States attorney for the District of Massachusetts. Republican U.S. Senator Tom Cotton said he would try to prevent Rollins from being confirmed, saying she supported policies that have contributed to an increase in violent crime. Senator Ted Cruz also criticized her for stating she would not prosecute certain crimes, such as trespassing, breaking and entering, larceny, resisting arrest, wanton or malicious destruction of property, drug possession with intent to distribute, driving with a suspended or revoked license, and several more.[27] In September 2021, a committee vote to advance Rollins' nomination was delayed after Cotton wanted more time to convince colleagues to oppose her.[28][29]

Yet she did not include these on her

proposed Charges To Be Declined (by United States Attorney for the District of Massachusetts who was formerly Suffolk County District Attorney in Massachusetts) come close to this:

Charges To Be Declined

Charges for which the Default is to Decline Prosecuting (unless supervisor permission is obtained).

  • Trespassing
  • Shoplifting (including offenses that are essentially shoplifting but charged as larceny)
  • Larceny under $250
  • Disorderly conduct
  • Disturbing the peace
  • Receiving stolen property
  • Minor driving offenses, including operating with a suspend or revoked license
  • Breaking and entering — where it is into a vacant property or where it is for the purpose of sleeping or seeking refuge from the cold and there is no actual damage to property
  • Wanton or malicious destruction of property
  • Threats – excluding domestic violence
  • Minor in possession of alcohol
  • Drug possession
  • Drug possession with intent to distribute
  • A stand alone resisting arrest charge, i.e. cases where a person is charged with resisting arrest and that is the only charge
  • A resisting arrest charge combined with only charges that all fall under the list of charges to decline to prosecute, e.g. resisting arrest charge combined only with a trespassing charge

Instead of prosecuting, these cases should be (1) outright dismissed prior to arraignment or (2) where appropriate, diverted and treated as a civil infraction for which community service is satisfactory, restitution is satisfactory or engagement with appropriate community-based no-cost programming, job training or schooling is satisfactory. In the exceptional circumstances where prosecution of one of these charges is warranted, the line DA must first seek permission from his or her supervisor. If necessary, arraignment will be continued to allow for consultation with supervisor. Thus, there will be an avenue for prosecuting these misdemeanors when necessary but it will be appropriately overseen by experienced prosecutors.

Note: this is essentially already happening for drug possession cases in Roxbury and Dorchester District Court
