New York Creates Precedent That Could Threaten Every Big Business In New York, and Send Them Fleeing, With Their Money, to Safer Climes; Kathy Hochul Reassures Them By Admitting This Law Will be Applied to Trump Only and No One Else
Jonathan Turley on the huge, and unconstitutional, penalty the open partisan hack judge levied on Trump -- and his demands that Trump put up the money for his exorbitant fine before Trump is allowed to challenge the fine as excessive.
n the wake of the massive judgment against Donald Trump, many in New York are celebrating the prospect that the former president could be forced to sell off his property just to appeal the $355 million judgment against him. While Trump has good grounds to object to this excessive fine, he still has to come up with close to a half billion dollars just to make his arguments to the New York Court of Appeals.
In order to file an appeal, the courts require a deposit for the full amount of the damages or a bond covering the full amount. Even with escrow options, the call for cash or collateral can be enough to put some executives in a fetal position.
It can be challenging enough for many companies drained from years of litigation. For Trump, the demand for $355 million plus about $100 million in interest could force a fire sale on properties to pony up just the deposit.
Engoron has also decreed that Trump is not allowed to "do business" in New York, which includes borrowing from his previous lenders to pay the money for this bond.
In other words, Engoron has both levied an excessive fine against Trump, while simultaneously forbidding him from obtaining enough in loans to pay for the bond to protest the excessive fine.

Isn’t this selective prosecution? I thought that isn’t legal.
“THIS CANNOT STAND!”
Eighth Amendment of the U.S. Constitution:
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
Suck on THAT NYC commies.
It WILL NOT and CANNOT be contained in New York. It sets the precedent and template for using lawfare to destroy politicians in the Blue States all over the country.
We always think "this bad idea can be contained to California. Or New York. Or universities." But the bad ideas ALWAYS spill out of their confines and get adopted all over the place.
“...a sophisticated and big ticket form of “debtor’s prison.”
That is a GREAT analogy! They no doubt want to imprison Trump if he cannot pay their demands.
How do you perceive them applying that three-part test to the assault on Trump?
Good God, this is staggering and beggars disbelief. Those bastards set it up so Trump has to pay the full fine or post a bond to contest the ruling, then made it impossible for Trump to get a loan to post that bond. In other words, they are denying him appeal rights, all through a Bill of Attainder.
If they succeed at this lawfare, it will spill out of NYS to other blue states. NYS is chumming the lawfare waters and the sharks are circling. This could truly be the end of the Republic.
Why aren’t our putative “Republicans” in Congress and statehouses screaming about this egregious and outrageous scheme and the dire threat it poses to ALL of us?
Unfortunately a business backlash would be slow and occur under the radar. If a big firm like Goldman Sachs or JP Morgan said we’re out of here, that would have an impact.
Sounds like Obozo is running operations behind the scenes. Destroying Trump is an absolute requirement for Michele to run for office and have Obozo as VP.. No one can beat Trump.
SCOTUS - Where are you?
Remington just left the state.
COULD threaten? No - DOES threaten!!
Is a court judgment a “law”?
Nope
Gov Hochul said not to worry. They only wanted to get Trump.
Betcha she’s going to wish she hadn’t said that.
I noticed that. I don't think that the NY law mentions Trump (Bill of Attainder), but they are using it as if it did.
> No savvy business will remain there.
No problems. Nothing will show up in the news until after the election - which is all that counts.
Anyone who doesn’t join in the outrage is on the wrong side.
I heard that people are laughing at Trump’s persecution. Not a good plan.
This isn’t over, wokesters.
So, where us Trump’s appeal based on the eighth amendment?
They don’t care. If they end up owning the businesses in NY, they’ll we fine with that.
Rhetorical question.
