Alabama couple awarded $1 million for unconstitutional police raid they say left them homeless

Randolph County couple Greg and Teresa Almond were recently awarded $1 million in punitive and compensatory damages after a federal jury determined that deputies illegally raided their home six years ago.

On Jan. 31, 2018, Randolph County Deputy Sheriff Nathaniel Morrow arrived at the Almond home around 2 p.m. and told Teresa that he was there to serve paperwork related to ‘a civil matter,’ according to documents from a federal civil rights lawsuit the couple filed in 2019.

Teresa told Morrow that Greg wasn’t home but said that he could return in two hours to give him the paperwork then.

Two hours later, a county drug task force returned based on Morrow’s claim that he smelled marijuana on the premises.

Shortly after Greg returned home, members of the task force kicked in the door of the Almonds’ home and threw a “shock” explosive device inside the residence...

During last month’s trial, Randolph County Circuit Judge Amy Newsome testified that she had never issued any kind of warrant for the sheriffs to search the Almond home.

Newsome added that she had also not communicated anything to them over the phone that would have allowed them to act in good faith, according to court documents.

Is $1 million enough? Should be more or at least $1 million plus all legal costs. And how about those involved being fired?

> The search turned up less than $50 of marijuana… <

Well, that settles it. The cops smelled marijuana. A SWAT raid, deployment of a shock grenade, and seizure of the couple’s personal property, it all makes sense now. Not.

Tough times are ahead for this country. Decent people and the police need to be on the same side. Too often that’s not the case. And it’s not the fault of the decent people.

RE: no warrant was issued....

In the movie Rio Lobo the writer George Plimpton played “the
4th gunman” sent to shoot John Wayne. When asked for a warrant he said::
“I got a warrant right here, sheriff.”
He gets shot to death.

From the article:

...

The search turned up less than $50 of marijuana and one Lunesta pill outside of the bottle that Greg had been prescribed.

Under Alabama’s civil asset forfeiture laws, which allow law enforcement to seize any property they allege is involved in a crime, Randolph County deputies seized approximately $8,000 in cash, firearms, jewelry, and other personal items from two safes inside the Almond home, according to court documents.

...

Over a year later, the Almonds were indicted on unlawful possession of marijuana for personal use and unlawful possession of drug paraphernalia, both misdemeanor charges. Prior to this incident, neither Greg nor Teresa had any criminal history.

...

1) Civil Forfeiture must end. It is simply state-sponsored robbery.

2) Congratulations, Drug Warriors!!! You got those eeevul pot smokers!

3) Police are their own worst enemies. The "profession" as a whole is no better than the worst psycho they tolerate in their midst. There seem to be a lot of psychos ...

I too was surprised by the relatively low amount awarded to the victims here. Perhaps there is some sort of statutory maximum in cases like this.

If not, the jury did a damn poor job. I suppose their minds might change if someday a SWAT team breaks down their door after “smelling marijuana”.

That’s just sad. Everyone involved arresting them and charging them should be fired. I wonder how much they pocketed for themselves.

That should provide them some incentive to mind their manners ...

But seriously ...

The extent to which "we" tolerate murder, rape, robbery, and other crimes IN PRISON is a blot on our society. Prison is supposed to be a punishment, not a playground for violent perverts.

Well, it's not like Trump called them liars. Otherwise, they'd be looking at an $80,000,000+ payday.
