The feud between the Biden administration and the state of Texas over the southern border has set the stage for one of the biggest immigration fights between the federal government and a state government in more than a decade.
Republican Texas Gov. Greg Abbott recently had his authorities seize city property along the southern border, arresting migrants crossing illegally for trespassing, which the federal government has vocally opposed. The Biden administration subsequently asked the Supreme Court to intervene, arguing that Texas is overstepping its authority, sparking a legal battle the high court hasn’t seen since 2012.
“Courts traditionally have said that states have only a limited role to play when it comes to enforcing our immigration laws. Texas is now challenging that traditional assumption and we’ll have to see how the courts rule on this important issue,” Stephen W. Yale-Loehr, professor of immigration law practice at Cornell, said in an interview with the Daily Caller News Foundation

And FYI...I'm not saying that Abbott is doing the wrong thing. I agree with him completely. All I'm saying is that The Big Guy holds all the cards here...legally speaking.
Feds have completely abdicated their responsibility to enforce the immigration laws. I attended a presentation on this subject at my law school twenty years ago. Nothing has changed since then. States were discussing whether, in light of the Federal government’s failure, states had the obligation to pass immigration laws of their own.
Let's hope it turns out better this time because I do not wish to foot the bills for Blue States fiscal and immigration foolishness.
The Battle of Eagle Pass

> Yah,until The Big Guy sends in the National Guard to clear out the state and local guys.<
The state and local guys ARE the National Guard. Biden would have to federalized the Texas National Guard to take control. He can only do that by declaring an emergency. That plays right into Texas’s hand of defending itself during an emergency.
The arguments in court from the DOJ would be pure comedy.
DOJ: We are acting on an emergency.
Judge: What caused the emergency?
DOJ: Our inaction caused the emergency.
Judge: Do you people even listen to your own words?
Biden cannot use the military. It will be a showdown of feds showing up and being arrested under state law.
EC
Abbott needs to call the actions of the Traitorjoe kakistocracy for what they are - giving aid and comfort to the domestic and foreign enemies of the United States.
I believe this is more state versus state. Abbott is directing “migrants” to states which want to impose their will on Texas. The BS of the article is deflection. There are also reports of the border patrol welcoming national guard take-over in Texas.
The irony is, I am fast coming to the conclusion that states like New York are welcoming this. The peons who think that the schools are for their children need a taste of the New Order. The flood may even be so high as to get Abbott to do this.
“Yah,until The Big Guy sends in the National Guard to clear out the state and local guys”
“The National Guard is composed of Texans”
And under the command of the Texas Governor not JoeK Bimentia
Yup. Phrase it in accordance with the definition of Treason and put it in the context of Impeachment. It’s blatant. Aid and comfort to a foreign invader. And if some in the legislative branch will not hold Biden to account, replace those who fail to do their duty. The whole 2024 election should be focused on this, and on the weaponization of the DOJ.
“Courts traditionally have said that states have only a limited role to play when it comes to enforcing our immigration laws. “
And if the Feds don’t do their constitutionally mandated duty to protect the border then any state that wants to can tell the Feds and the courts for that matter to go to hell.
Remember the route of General Santa-Anna by Sam Houston.
Take Texas back from this fascist left demographic invasion designed to convert Texas into a blue state, where cowboys will be supplanted by sexually transitioning, denutted, mentally ill Biden favorites..HELL NO !
I keep thinking of the scene in “Gods and Generals”.
Some states had seceded from the Union, but Virginia had not yet taken that step. President Lincoln notified Virginia to call up three regiments, in the event of civil war. General Stonewall Jackson addressed those troops after Virginia seceded and said, “Tell the president we have done so.”
A DECADE.!! It SHOULD be the the biggest sense 1776.! It's well pass time that the states slap the federal government around a bit and remind them who's REALLY in charge!! AND RESEND THE 17th. AMENDMENT.! :(
You might wanna check your facts here. Every uniformed member of the Armed Forces...active duty, reserves,National Guard...are subject to the Commander-In-Chief’s orders. Members of the Army and Air National Guard are under the command of the state’s Governor under certain circumstances. But the President can,at any time,”Federalize” (my word) the Guard at which point the Governor ceases to have any command authority..
Hmmmm... That should have been “Rescind” the 17th. amendment... No coffee yet.
It has been reported that other states have sent personnel to support TX efforts
along the border, and it is uncertain how many of these assets are in Eagle Pass.
Any use of force by the Feds could send the tensions between
red states and the Biden regime into the red zone very fast.
.
Crossing into America is a Federal problem. Once they hit Texas it is a Texas problem. And Texas is doing what they are supposed to do. Arrest, fingerprint and send them back to their home countries. All that is left is to send Biden the bill.
States have a right to protect their citizens.. Family in El Paso say it’s not safe there. No one in our government would live that way.
States should have done this months ago.
