Laura Loomer Goes Full Birther Over Nikki Haley: The "Natural Born" Constitutional Requirement Issue Comes to the Fore
PJ Media ^ | 12/26/2023 | Matt Margolis

Laura Loomer, a die-hard Trump supporter, is taking a page out of Hillary Clinton’s playbook by going into full birther mode.

'Nikki Haley Is An Anchor Baby Who Is Unqualified To Be US President,” an article posted to her website on Christmas Eve insists. Her piece argues that since her parents were Indian immigrants who didn’t become naturalized U.S. citizens until after her birth, Haley is an “anchor baby” with birthright citizenship and doesn’t qualify as a “natural born citizen."

She shared her article on X/Twitter, and users promptly flagged it with a Community Note.

NEW:@NikkiHaley Is An Anchor Baby Who Is Unqualified To Be US President

MUST READ! 👇🏻 https://t.co/7070uvKLqa— Laura Loomer (@LauraLoomer) December 25, 2023

Loomer was livid when a Community Note flagged the post. "Why do @CommunityNotes censor factual posts?" she asked in a follow-up post on X/Twitter. "Read this article and see for yourself how this is wrongfully community noted. Natural born citizenship isn’t the same as birthright citizenship."

There were plenty of her supporters agreeing with her, as well as those calling her out for being flat-out wrong.

But what are the facts? Here’s what the Legal Information Institute of Cornell University says on the matter:

A natural born citizen refers to someone who was a U.S. citizen at birth, and did not need to go through a naturalization proceeding later in life. Under the 14th Amendment's Naturalization Clause and the Supreme Court case of United States v. Wong Kim Ark, 169 US. 649, anyone born on U.S. soil and subject to its jurisdiction is a natural born citizen, regardless of parental citizenship. This type of citizenship is referred to as birthright citizenship. One can be a citizen while not being a natural born citizen

This is how Twitter/X Community Notes Flagged Loomer’s Tweet:

This is false. The Constitution lists only three qualifications for the Presidency: Be at least 35 years old, be a natural born citizen, and must have lived in the United States for at least 14 years. Haley meets all of those. ‘Anchor babies’ are not illegal.

Cabinet member Jennifer Granholm was born in Vancouver, British Columbia, Canada and is ineligible to be in the line of succession to the Presidency.

Popular former Governor of California Arnold Schwarzenegger was born in Thal, near Graz, Austria and could not run for President.

I feel that the Supreme Court has to step into this issue and look at this constitutional requirement seriously once and for all.

The only question is — WHO HAS THE STANDING TO BRING IT BEFORE THE SUPREME COURT?

I finally found this little nugget of an oblique reference to natural-born citizens in Federalist #68, by Alexander Hamilton, discussing the Electoral College. It was assumed that the Electors, separated across all of the states, would investigate and decline to vote for "creature[s]" of "foreign powers."

Federalist #68 (Alexander Hamilton):

Nothing was more to be desired than that every practicable obstacle should be opposed to cabal, intrigue, and corruption. These most deadly adversaries of republican government might naturally have been expected to make their approaches from more than one querter, but chiefly from the desire in foreign powers to gain an improper ascendant in our councils. How could they better gratify this, than by raising a creature of their own to the chief magistracy of the Union? But the convention have guarded against all danger of this sort, with the most provident and judicious attention.

What could Hamilton possibly have meant by "creatures of their own" raised by foreign powers? Could these "creatures" be children of non-citizen parents who still hold allegience to their home country?

What did Hamilton mean by "the convention have guarded against all danger of this sort" if not for both the natural-born citizen requirement for the President and the original intent of the Electoral College?

Earlier in Federalist #68, Hamilton writes:

It was equally desirable, that the immediate election should be made by men most capable of analyzing the qualities adapted to the station, and acting under circumstances favorable to deliberation, and to a judicious combination of all the reasons and inducements which were proper to govern their choice. A small number of persons, selected by their fellow-citizens from the general mass, will be most likely to possess the information and discernment requisite to such complicated investigations.

Today's Electoral College is a rubber-stamp for the candidates, pre-selected state-wide slates of party insiders that vote the Electoral College allocation for the candidate.

What the Framers intended was for non-government citizens to be selected in each locality (Congressional district) to meet at the designated time, to "analyze the qualities" of the candidates, and "possess information and discernment requisite to such complicated investigations."

In other words, the Hamilton expected the Electoral College to review the qualifications of the candidates, weed out the reprobates and foreigners, and then vote for the person whom they thought was best "adapted to the station" to be President.

These were the "guards" of "provident and judicious attention" that Hamilton was referring to, that would be on the lookout for "all dangers of this sort."

The biggest danger, enough of a concern to be mentioned in Federalist #68, was "creatures" of foreign powers becoming President.

“‘Anchor babies’ are not illegal.”

Note to Twitter/X community: The Constitution stipulates natural born; naturalized citizens are merely legal.

Not a lawyer nor a Constitutional expert, but I’ve seen lots of opinions on the meaning of ‘natural-born citizen, including some that said my dad and uncles weren’t natural-born citizens because my grandfather had not yet gotten his American citizenship at the time of their births, regardless of the fact that grandma was an American citizen and that they were all born in the U.S.

To answer the question we need to try figure out what the authors of the Constitution meant when they wrote the words. The phrase reads: “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President”. This means that they were OK with someone becoming President no matter where they were born as long as they were citizens when the Constitution was ratified.

Naturally, all of the Founders were citizens of another nation, Great Britain, at their births, but had Lafayette, Von Steuben, or Pulaski become citizens before the Constitution had been ratified, they would have been eligible to be President.

This implies to me, that they weren’t all that worried about parents’ citizenship status but rather the individual in question. But I’ll admit I could be wrong.

I thought “natural born citizen” was actually clearly defined in English common law which the Founders used for parts of the Constitution. The Founders after establishing a country did not want a future President who may have been born here from a foreigner , to be eligible for President. Natural born with 2 citizen parents would not owe loyalty to any other nation. (Except they didn’t foresee an Obama or Harris who were mostly raised outside of the country)
