WASHINGTON, DC – Jack Smith’s appointment as special counsel is unconstitutional and so the Supreme Court must reject his petition against Donald Trump, lawyers representing former Attorney General Ed Meese and two top constitutional scholars in the country argued in a brief filed on Wednesday.

Isn’t that an old claim? I don’t see Trump’s attorneys challenging Smith. But he gets what he pays for and it is not good attorneys.
Good arguments. Let’s see if they hold water, and, how SCOTUS would handle it. They usually try to limit their rulings to narrow topics. I wonder if they would throw out the appointment of special prosecutors and dismiss the cases brought by Smith, or just rule that he has no standing to ask SCOTUS to rule on anything... which would imply he has no standing on the DOJ case but the lower court could rule otherwise, or, Garland could take the case up himself.
One of the very best AG’s ever... Edwin Meese.
They will say it has no standing.
VERY interesting argument.
Heads up
“Improperly appointed, he has no more authority to represent the United States in this Court than Bryce Harper, Taylor Swift, or Jeff Bezos,” they write.
I have not researched this topic, but it certainly sounds like a valid argument.
This special counsel position was not created by Congress, nominated by the president, or confirmed by the Senate, as the Constitution requires.
I remember this from when he was appointed. I’ll see what Dershowitz had to say at the time.
“One of the very best AG’s ever... Edwin Meese.”
Wedtech scandal.
“... the brief argued that Smith has so much power, just like a U.S. Attorney, he is a “principal officer” under the Constitution’s Appointments Clause, which means he must first be nominated by the president and then confirmed by a majority of the U.S. Senate.”
So Biden will nominate him, and the Dem majority controlled Senate will confirm him.
Meece is 92 years of age. Is he still practicing?
The indictments should be thrown out and Smith will have to start over and do things "the right way."

To what position?
United States Attorney for the District of Joe’s Garage?
The Central Scrutinizer?
Let’s say, your correct in your analysis.
Even using your analysis, your therefore CONCEDING THAT everything prior to Biden nominating him, and the Dem majority controlled Senate confirming him (Jack Smith) WAS UNLAWFUL, “ab initio.”
Legal Phrase meaning “from the beginning,” = Ab Initio.
By any chance are you maybe knowledgeable about the Legal Phrase: “FRUITS OF THE POISONOUS TREE.”
In case you don't know; again by your analysis, your invoking “FRUITS OF THE POISONOUS TREE.” Legal Doctrine.
Please define "practicing."
If you mean still going to the local county / town court with clients, in cases from say DUI's to Wife beating, common every day will's and such, answer my guess would be no.
At his firm (firm = His Name on the Door & Letterhead of the LAW Firm; engaged in the practice of law, receiving a paycheck,) talking legal theory and such, meeting clients, having lunches with some of those clients; then my answer is yes; 92 years of age Ed Meece, is still practicing LAW.
Personally I'm hoping I wrong, and that Meece; is still going to the local county / town court with clients, in cases from say DUI's to Wife beating.
I remember the late great Rush Limbaugh, interviewing his mid 80's grandfather, was still practicing LAW, i.e., was still going to the local county / town court with clients, in cases from say DUI's to Wife beating, writing will's.
Guy was as sharp as a tac, and knew which way the wind was blowing from!!!!
