A North Central Florida state attorney is moving forward with the first effort in the state to pursue the death penalty for an accused child rapist under a new law enacted earlier this year.
State Attorney Bill Gladson announced Thursday in a press release that a Leesburg man, Joseph Andrew Giampa, was indicted for six counts of rape of a child under 12 and three counts of promoting a sexual performance by a child.
“Given the severity of the crime and its impact on the community, the Fifth Judicial Circuit State Attorney’s Office has filed a notice that it intends to seek the death penalty,” Gladson’s office said in the release.
“The decision to pursue the highest penalty reflects the gravity of the charges and the State Attorney’s Office’s dedication to holding criminals accountable for their actions,” the prosecutor’s statement continued.

It is been my understanding that the reason there has been no death penalty for such crimes was the logic that if the penalty for getting caught was death, then there would be no incentive to leave any witness to the crime alive. Not sure I completely agree with that.

He should get life in prison in the general population. Perp will be killed by other inmates before the state gets around to executing him.
Florida Gov. Ron DeSantis signed a bill in May that authorized the death penalty for child rapists.“We think that in the worst of the worst cases, the only appropriate punishment is the ultimate punishment,” DeSantis said at the time.
“And so this bill sets up a procedure to be able to challenge that precedent to be able to say that in Florida, we think that the worst of the worst crimes deserve the worst of the worst punishment and I think that that’s the only thing that’s appropriate.”

Actually rape of any kind was a capital offense in many states but the USSC ruled in the 1970s that the penalty “excessive”.

Yeah, the Supreme Court ruled against it. Not sure how it has that authority. Like 90% of 20th century executions for rape were black criminal, white victim, which is maybe partly why the USSC got involved.

Louisiana had a similar law - the Supreme Court threw it out a few years ago.
The decision was very superficial with regards to “harm to the victim” being insufficient to deserve death.
Maybe that’s true in some cases.
But there are other cases where a painless death is grossly inadequate.
