A Texas woman whose fetus has a fatal diagnosis and who has been awaiting a decision from the Texas Supreme Court about whether she will be allowed to get an abortion said Monday that she has decided to leave Texas to get the procedure.
Kate Cox, a mother of two who is around 20 weeks pregnant, found out just after Thanksgiving that her developing fetus has trisomy 18, a fatal diagnosis. Seeking to terminate the pregnancy to protect Cox's health and future fertility, she and her husband sought a court order to block Texas’ abortion bans from applying in her case.
A district judge granted the request Thursday, but Texas Attorney General Ken Paxton sought an emergency stay from the state Supreme Court, which then paused the lower court’s order Friday evening.
"Due to the ongoing deterioration of Ms. Cox’s health condition ... Ms. Cox is now forced to seek medical care outside of Texas," Molly Duane, senior staff attorney at the Center for Reproductive Rights, which is representing Cox, said in a court filing Monday.
However, Duane also said in the filing that "because the issues in this case are capable of repetition yet evading review, the Plaintiffs nonetheless intend to proceed with their case."
In a statement Monday, Nancy Northup, president and CEO at the Center for Reproductive Rights, said: "This past week of legal limbo has been hellish for Kate. Her health is on the line. She’s been in and out of the emergency room and she couldn’t wait any longer."
"She desperately wanted to be able to get care where she lives and recover at home surrounded by family," Northup added. "While Kate had the ability to leave the state, most people do not, and a situation like this could be a death sentence."

Scanning the online literature about this condition, I see nothing about how it endangers the life of the mother. Lacking other information, I’d surmise that they are leaning on the ambiguous “mental or psychological health” of the mother. The only danger is to the child, who may not survive the pregnancy or not survive long after birth. In other words, this woman probably just not want to carry this poor child to term, either not wishing to deal with delivering a stillborn baby or raising a disabled child for however long he or she survives. Very sad and very maddening that hardships like this have become a political issue.

I knew this woman was a complete sicko and being the test case to promote more insane infanticide in “red” states. It is a absolutely heartbreaking situation for the unborn. The abortion issue is shifting all elections to the left and it is not looking good. Even some women on the right side of things get wobbly when it comes to “choice”.
Exactly. Did not this child have enough of a bad hand? Does he/she really need the added offense of being killing by parents like a thing? At least they could have shown some tenderness and blessed the baby with love and respect for it’s expected short life.
The oldest known trisomy 18 child just turned 40 and lives with her parents in OK.
“I think when she lost her first tooth I almost cried,” said Sara Hayes. She said Megan is “eager to please,” and loves to laugh, watch sports with her father, read books with her mother, and go to church on Sundays. She has also graduted from high school.
“It’s a delight. It’s a delight. She wakes up every morning happy, smile on her face,” said her father, Ron Hayes. “It’s not a death sentence for having a child like this.”
In recent years, some doctors have realized that with the right medical care, people with Trisomy 18 can live longer than previously thought possible, and more stories of people with the condition beating the odds have been surfacing.
“These kids really are living, and they are doing these things,” said Sara Hayes. “[…] The doctors don’t know what to tell us. […] She’s a miracle. I don’t know how else to explain it.”
