A key US spy tool will lapse at year's end unless Congress and the White House can cut a deal

The tool is called Section 702 of the Foreign Intelligence Surveillance Act

With just seven weeks until the end of the year, the Biden administration is running out of time to win the reauthorization of a spy program it says is vital to preventing terrorism, catching spies and disrupting cyberattacks.

The tool, Section 702 of the Foreign Intelligence Surveillance Act, will expire at the end of December unless the White House and Congress can cut a deal and resolve an unusually vexing debate that has yielded unlikely alliances at the intersection of privacy and national security...

This year, a key point of contention is the insistence by some in Congress, over the strong objection of the White House, that federal agencies be required to get a warrant before they can access intelligence collected on people …

A warrant requirement is supported by Republican Rep. Jim Jordan, the chairman of the House Judiciary Committee and one of the most pro-Trump members of Congress, and Democratic Sen. Ron Wyden, a reliable champion of civil liberties and liberal standard bearer for decades.

Wyden last week released a bill with a bipartisan group of lawmakers — including Republican Rep. Andy Biggs, a vocal Trump supporter — that would mandate a warrant to access the communications of people inside the U.S., except for limited exemptions such as when officials need to stop an imminent threat to public safety or if the subject of the query has consented to the search.

A senior administration official told reporters before the bill was even announced that a warrant requirement crosses a “red line” for the White House given that it would limit officials' ability to detect, and act on, potentially vital intelligence in real time…

It was Admiral Mike Rogers who as head of the NSA (and one of the apparently few good guys in the Trump Russia-gate story) who shut down “contractor” mining and abuse of these section 702 rules.

The DNC and FBI simply had “contractors” do the mining of data on Trump under this 702 authorization. Rogers then warned Trump he was being illegally spied upon. Trump literally moved his campaign headquarters to his NJ golf club the next day. The filthy deep-state hacks Clapper and Brennan wanted to go after Rogers for that.

It was after that the FBI then went on the abuse of FISA route to continue spying on Trump.

Anyone concerned about the Constitution would demand radical changes to this Section 702 law.

I am concerned about it. They aren’t going to give it up and go into the night.

The founders of this nation understood too well the flaws and dark sides of Man, and tried to design a system to protect us from our fellow man.

And the truth of it is, that none of us is trustworthy with that kind of power. George Washington knew that well, as did many of the others.

and maybe next they can work on not lying to the FISA court to get a warrant to listen to innocent people’s communications…

According to a declassified FISA court opinion this year, the FBI committed FISA violations 278,000 times in recent years, including on people believed to be connected to violent George Floyd protests and the Capitol riot.

The current Foreign Intelligence Surveillance Act (warrantless searches etc.) was signed into law by Trump.

Were there ever any consequences for the people that lied to the FISA court to get a warrant, and later used that warrant to spy on then candidate Donald J. Trump?

I think the law should require a warrant when a US citizen is the subject, and I also believe that purpisefully violating this requirement shiould be made a capital offence. Execution by firing squad.
