'No company is too big': NY AG James files lawsuit against PepsiCo for pollution in Buffalo (NY) River

NEW YORK (WKBW) — New York Attorney General Letitia James has filed a lawsuit against PepsiCo Inc. James announced the lawsuit Wednesday at Canalside alongside state and local leaders.

The lawsuit alleges that hundreds of PepsiCo products have been found along the Buffalo River and caused public harm in Buffalo. "And at the end of the day people that produce things have a responsibility for the things that they produce and this announcement demonstrates that no corporation how big or small how powerful or wealthy they may be in above the law," Assemblymember Jon Rivera said.

In addition, the lawsuit charges PepsiCo with failing to warn consumers about the potential environmental and health risks of its single-use plastic packaging.

NY and other states, desperately needs income, so AG's have decided to become class action lawyers filing massive frivolous lawsuits.

Once a product is sold, doesn’t it belong to whoever purchased it?

It may belong to the purchaser however it could still be the manufacturer’s and seller’s responsibility in the case of product liability.

I haven’t reviewed this particular complaint yet so I don’t know which theories of liability are being asserted.

I’m pretty sure the bottles say “please recycle” on them... they also likely have the type of plastic used imprinted, a de facto “warning” about their hazards. If NY is like CA there is a tax paid for single use containers, which can be refunded at least in part to people who return them to recyclers. Unless that money just goes to the state’s general ‘hire more government employees’ fund.

Sure if a company knowingly or through negligence makes a dangerous product they can be held liable (except for covid vaccines) but generally when you buy something the rights to it belong to the purchaser. Hard to imagine what PepsiCo can do to prevent the purchaser from throwing a bottle in the river... especially if it contains a message.

Don’t think so. This is just grandstanding in Buffalo. After all, it is right next-door to Niagara Falls and Love Canal. Maybe should go after the tabacco companies for all the cigarette butts droped on the ground. How about all the tire companies for the rubber compound polluting the land with rubber compounds worn off tires. Shakespeare’s quote about killing all the lawyers in the event of a revolution is perhaps a leading cause for having another revolution. The same could be said for politicians, used car salesmen, ad infinitum.
