Federal Judge Blocks Nationwide Enforcement of Pistol-Brace Ban

The ATF can’t arrest anyone for owning a pistol-brace-equipped gun.

That’s the outcome of a ruling handed down by United States District Court Judge Matthew Kacsmaryk on Wednesday. He granted a motion to stay enforcement of the agency’s rule banning the possession of effectively all braced guns that weren’t registered earlier this year. He found the ATF exceeded its power when crafting the rule.

That throws a monkey wrench in the argument that bump stocks make AR semiautomatics into fully automatic weapons of war and illegal. The critical assumption has just been deep sixed. There therefore, AR semiautomatics can not be regulated as fully automatic weapons of war.

I guess that would require the courts to rule in such a way as to limit the federal and local government LEOs possession of law enforcement weapons to that of the populace. It is a fact that citizens encounter Lawless thugs more often than the law enforcement. If the citizen's rights to keep and bear arms are limited, they should be limited to no less than that of law enforcement. Make that the test to which laws apply. Pipe dream but fair.
