The new leader of one of the chambers of Congress that will certify the winner of next year’s presidential election helped spearhead the attempt to overturn the last one, raising alarms that Republicans could try to subvert the will of the voters if they remain in power despite safeguards enacted after the 2021 attack on the U.S. Capitol.

What’s ironic is that a competent constitutional lawyer would have known that many of the measures taken to challenge the results of the 2020 election were futile at best and (in many cases) lacked any constitutional basis.

In a hypothetical question example that played out multiple times in 2020, State X has no legal standing to use the Federal courts to compel State Y to enforce its own election laws. This is where the infamous Texas lawsuit was destined to fall flat on its face regardless of the actual facts of the case.

You have to love that “election denier” is getting traction as a serious election issue.

Heck, the next president may depend on who is, or who isn’t, an “election denier.”

As a corollary, being a 2020 “election believer”.......is equally as potent an election issue.

There were the attackers but not all that happened there on Jan 6 was violent. Some attacked it while others did not. That’s the “tale of the tape”.

In your hypothetical, who does have legal standing to use the federal courts to force a state to follow its own election laws, or more likely, to follow Constitutional requirements?

There’s no doubt in my mind that the 2020 election was corrupted behind repair. I’ve been saying this since even before Election Day in 2020.

The measures taken to “fix” it, however, were completely ineffective and (in many cases) carried out by inept fools.

The citizens of the state where the election laws were violated have clear standing — in STATE court.

And what particular “Constitutional requirement” is involved here?

P.S. — the Federal courts can only take action in cases where Federal laws or constitutional issues are at stake. That’s why election challenges in Federal courts are almost always based on matters related to the Civil Rights Act or the Voting Rights Act.
