The Supreme Court on Oct. 6 lifted a lower court order blocking the Biden administration’s rule regulating so-called ghost guns that can be assembled at home, allowing the policy to remain in force until Oct. 16.
The new order from Justice Samuel Alito came late in the day on Oct. 6 in an emergency application in a case known as Garland v. Blackhawk Manufacturing Group Inc. (court file 23A302). U.S. Attorney General Merrick Garland filed the application on behalf of the Biden administration.
The lower court order is now administratively stayed until 5 p.m. on Oct. 16.

The government’s “frame or receiver” rule goes back to April 2022. It requires individuals who assemble homemade firearms to add serial numbers to them. The rule also mandates background checks for consumers who buy gun-assembly kits from dealers.

On July 5, U.S. Judge Reed O’Connor of the U.S. District Court for the Northern District of Texas issued an injunction after finding that the regulation violated existing law. Judge O’Connor found that the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), which is part of the U.S. Department of Justice (DOJ), went beyond its statutory jurisdiction in regulating “partially manufactured firearm components, related firearm products, and other tools and materials.”
The rule “is unlawful agency action,” the judge found at that time.

Supreme Court Temporarily Reinstates Biden Admin’s 'Ghost Gun' Rule
I seldom hear of "ghost" guns being used in crimes. They are mostly for gun enthusiasts who enjoy building their own firearms. Or, at least that is my understanding. Criminals can barely keep their stolen firearms operational given they mistreat them, don't clean the guns, and often use the incorrect ammo. Which is lucky for many of their potential victims since that is what causes their guns to jam when the criminal pulls the trigger.

I don’t know when it happened but somehow we’ve allowed the courts to rule on anything to do with guns!?
The SCOTUS is a branch of government as are the legislative and executive branches.
They as such, have no business messing with the 2nd amendment or our right to own whatever we choose to own!🤬
So, now in America. If I want to make a hammer, a baseball bat or a knife, it’s illegal?
There has been an increase in recovery of Poly80 Glock clones from crime scenes, but the numbers are much lower than what the Biden administration would have you believe they are.
In 2021, there were 19,000 'ghost guns' recovered, over twice as many as were recovered in 2020 (8,500.)
But the part they don't tell you is that in 2021 there were 460,000 total crime gun trace requests in 2021, so that 19,000 is a small fraction of the total number of guns used in crime.
So is the stay lifted now?
