And the judicial system ought not to be used to abolish people’s civil rights, and impose totalitarian rule by thugs who set out to make opposition to the Uniparty a crime, and jail everyone who might express disagreement with them. He conduct of the J6 trials is utterly reprehensible and despicable. In the name of “Protecting our precious democratic racy???”

There are two aspects of the speech and debate clause:

  1. They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same;
  2. and for any Speech or Debate in either House, they shall not be questioned in any other Place.
Regarding #2, they are only protected for what they say on the floor of their chamber or in any other officially convened location where "speech and debate" is occurring, for example, at a hearing being held in another city. They are not protected when appearing on broadcast meddia or in print interviews, as that is not "speech and debate."

Item #1 extends their protection to traveling to and from DC. This would include walking the halls of Congress when they are in recess during hearings. There are two recent cases where this clause was brought up:

  1. In 2006, Rep. Patrick Kennedy (D-RI) was involved in a car crash with a barricade by the U.S. Capitol building at 2:45AM. Witnesses said that Kennedy was drinking at a nearby bar, but Kennedy said he was suffering from the effects of Ambien and thought he was driving to the Capitol to vote.

    Kennedy subsequently admitted to being addicted to sleeping pills and agreed to plead guilty to DUI of prescription drugs and entered a rehab program. There was talk that Kennedy should be protected by the "speech and debate" clause because he thought he was driving to work, but that was not followed up.

  2. In 2007, Sen. Larry Craig (R-ID) was arrested at the Minneapolis-St. Paul Airport for lewd conduct in a men's restroom. Craig was accused of soliciting sex in the bathroom, but Craig denied this claiming he simply had a "wide stance" and made incidental contact with the person standing next to him. Craig ultimately pleaded guilty to misdemeanor disorderly conduct and paid a nominal fine.

    The Senate after the 2006 election was tied 49-49 with two independents caucusing with the Democrats (they always do, but that's a post for another time). Conservative talk-radio (Mark Levin) brought up the "speech and debate clause" and said that Craig should not have been arrested because he was traveling home from Congress. I don't recall any mention of the charges being of the nature of "breach of the peace."

    Craig then said he wished he didn't plead guilty but was just trying to expedite the situation. He then filed a motion to reverse his guilty plea (which was denied) and said he would resign from the Senate, but a week later he reversed that statement and said he would serve out the rest of his term. He did not run for re-election.

Both of the above cases involved individuals involved in personal activities. Pulling the fire alarm is a mass event involving everyone in the building and surrounding areas. Even though this happened within the halls of Congress (by extension), this appears to be a case of breach of the peace that didn't exist in the above examples.
