Prince Harry still has a right to privacy in regards to his US immigration files despite publicly disclosing intimate and personal details about his life, the Department of Homeland Security says.
The Duke of Sussex had no qualms when it came to sharing private information in his memoir Spare – in which he even includes an anecdote about his frostbitten penis
But the DHS has argued that such previous public disclosures do not mean his visa records should be released
The Heritage Foundation is seeking the release of the documents as part of a Freedom of Information request it filed in March.
The think tank claimed that Harry could have lied about taking drugs in his immigration paperwork despite admitting doing them in his memoir and in the Netflix show.
Both sides were asked by a judge to try to work out differences on key points, but after that failed DHS filed a request for summary judgment, or to dismiss the case.
In the document, DHS went further than arguing that Harry still had a 'right to privacy' as it has done from the start.
Jarrod Panter, Acting Associate Center Director for Freedom of Information at DHS, wrote: 'Prince Harry has not consented to the release of records related to or reflecting information about him.
'Despite the public role that Prince Harry has played in the UK and despite information that he has disclosed regarding his personal life, he still maintains a strong privacy interest in his immigration status and information about him reflected in (immigration) records.
'Prince Harry has not publicly or officially disclosed his status in the United States and has not surrendered all rights to personal privacy

That may very well be the case, but it does not get you to proving Harry ever did illegal drugs, or that he lied on any immigration forms.
All he has to say is, “I’m very sorry but I lied in my book. I have never and would never do an illegal drug. That whole part in my book about doing drugs was a complete fabrication, and my immigration application is 100 percent accurate.”

And there are many people, in the UK, who can testify to the fact that Harry was smoking pot at 13 and doing cocaine whilst he was at Eton. As well as the fact that he was also an underage drinker and a drunk.
