HERE WE GO: Florida Attorney Files Legal Challenge Claiming Trump Cannot Be on 2024 Ballot Due to Alleged Involvement in Jan 6 “Insurrection”

A challenge has been filed in a federal court seeking a declaratory relief on the eligibility of President Donald Trump to run in the 2024 Presidential Election.

The petitioner cites Section 3 of the 14th Amendment of the U.S. Constitution, which disqualifies individuals involved in “insurrections” against the government from running for federal office.

The lawsuit, filed on Tuesday by Lawrence A. Caplan, alleges that Trump is constitutionally prohibited from running for president again due to his alleged involvement in the January 6 “insurrection” at the U.S. Capitol.

Caplan claimed he has participated in the last twelve presidential elections and is a legal resident of Florida. He is also a member of various state bars and federal courts, including the U.S. Supreme Court, asserting that this gives him standing in the matter.

Below is a transcript from the complaint:

"The facts of this case are undeniably simple. Donald J. Trump served a the 45th President of the United States having won the election in 2016 and was inaugurated on January 20, 2017. He served for four years until he lost the 2020 Presidential Election to Joseph R. Biden, Jr. who took office on January 20, 2021. President Trump chose not to appear at the inauguration of his successor. Having left for his estate in South Florida while the ceremony was taking place…

On January 6, 2021, after giving a speech to a throng on the Ellipse near the Capitol, President Trump exhorted the throng to march to the Capitol and told them that he would be right there with them. After he was finished with his speech, Trump returned to the White House and watched he later events unfold on television. As we are well aware, the throng marched on the Capitol, forced their way into the Capitol building, ransacked the rotunda area, and even made their way into several offices of representatives and senators…

Of note, President Trump had sent out a tweet the day before claiming that “January 6th will be wild”. Trump also later remarked that the insurrectionists who had breached the Capitol were “special” and that “we love you”. He also later remarked that had Vice-President Pence simply done his job and refused to certify the results of the election that everything would have been fine. Not for several hours were the National Guard called in to quell the insurrection as allegedly President Trump refused to do so and had been mesmerized by the events that were taking place on his television at the White House…"

Yes I agree with you on current circumstances.. Look at it like this: there can’t be another election until the country is fixed or obviously your prediction would be inevitable.. We all know given current circumstances DJ Trump has no chance of winning in 2024.

So I expect during coming weeks and months we are going to see events unfold that will at some point coverage to a constitutional crisis that will pretty much require the military to step in. Its going to something so bad the average American will say “thank God the military is stepping in.”.

My belief is that it will take a certain amount of time to clean out the remaining segments of this deep state cabal and ready the country for a free and fair election with paper ballots, voter ID and same day voting. I listen a lot of people with connections in high places and none of them think there’s going to be an election like 2020.

Impeachment is an indictment in the House. The ‘trial’ is in the Senate and a simple majority or plurality of aye votes is NOT ENOUGH to convict, PERIOD. He was never ‘convicted.’

I don’t have TDS, it must just seem that way to those of you who believe the man is some kind of god. Hopefully he won’t be blocked from any state’s ballots, but the odds are not in his favor. It will be yet another sad day for America, but we seem stuck on the Trump train whether we like it or not. Things keep going so bad for us at some point you have to wonder if there’s a script somewhere.

It isn't that simple.

9 States prohibit write-in voting for president. 34 states require a write-in candidate to file paperwork with the state often with a slate of electors who in turn maybe required to file with the state. As these documents often have specific requirements, I can see states rejecting the requisite paperwork.

What did I miss? I have not heard that President Trump has been convicted of insurrection. How can he be disqualified for something he hasn’t been found to have done?

I understand your possible scenario here. And it would be nice to see the military step in. But there are a few factors to consider. This is no longer our Constitution loving military. It has been infiltrated with woke socialists who actually hate this country, and would fire on U.S. citizens without discretion. They only do it for the pay and benefits period.

It has also been infiltrated by foreigners who are not even citizens in exchange for citizenship. And the big challenge for them all will be the fact they have children to feed and live paycheck to paycheck. They would have to perform all this patriotism without pay and benefits because they will be cut off immediately if they do.

Not to mention the UN troops who have been discretely staged around the country to prevent exactly what you shared. We would be fighting against the whole world on U.S. soil. And the people? The majority of the people are now socialists or non-citizens. And most of the few patriots left are too old like myself, too spoiled and lazy, or can’t miss a ballgame on TV.

The Democrats control enough of the machinary that they will successfully keep Trump off the ballot in key states.

The GOP will pretend to be outraged, hold hearings, send letters and do nothing. The USSC will declare that the issue is not their's to solve and will defer to congress. Congress will of course do nothing. The media will declare the whole thing constitutional and for the good of democracy.

There will be a lot of angry people with no plan as to what to do next or who to start shooting.

Why do you believe the strategy will be effective? Trump has not been convicted in a court of law of insurrection. They are basing it on an accusation.
