“This is gold—she asks defense to raise possible grand jury abuse by DOJ for conducting nearly all of the investigation in DC then switching to FLA at last minute for indictment.”

Some one with legal experience please comment. Is the Judge saying that they empowered a DC grand jury, did an investigation, then used the ‘selected’ evidence on another grand jury in Florida? Or did they use a DC grand jury to indict in Florida?

I don’t see how they could do the second, it violates due process.

Because of all of the malfeasance in DC by the prosecutor would come out in proceedings there. They can hide them better if they just go to trial in FLA.

They used a GJ in DC to indict then switched venues to FLA b/c they had to hide the corruption involved in getting the indictment in DC. If they had tried in FLA which was the proper jurisdiction, a FLA GJ might not have indicted Trump and if monkey business was used by Jack like it was in DC, they likely would have brought it to someones attention.

Yes, that is why it was moved.

“My guess is that they would’ve had trouble getting an indictment in Florida.”

That is exactly why. Even in Trump-hating DC, PsychoJack had to twist a lot of arms to an indictment with these flimsy charges.

She is smart to do this.

Re: "Why, though, would DOJ move from DC?"

Maybe they made legal errors in front of the DC Grand Jury?

Maybe they cleaned up the errors and re-stated the case in Florida?

The trial is in Fort Pierce, which is in St. Lucie County.

Trump beat Biden in St. Lucie County by 1.56%.

That means the MSM will constantly remind us that Trump won St. Lucie County in 2020.

That’s prosecutor misconduct and failure of due process if true. They have to start over with a Florida GJ, and a new prosecutor team. The ones involved violated the 4th Amendment rights of an immediate past POTUS. The ‘special prosecutor’ does this to a past POTUS, citizens have no chance!

Really is a Fascist State we are living in when this stuff happens. Also, it tells you that it’s garbage indictment in the first place done for political purposes. They would have done it clean, in the jurisdiction, and by the numbers if they a good case.

Since this is a special council, empowered by the POTUS, if the team does prosecutor misconduct, it reflects on the POTUS as a ‘High Crime’. Biden should be immediately impeached for putting a special prosecutor in that ignored due process for purposes. They needed to be squeaky clean, or it’s an impeachable offense to use the courts this way.

Congress needs to act swiftly now.

You are right. Yes, that is what is being alleged and why the Judge is encouraging Trumps lawyers and the others to look into the DC GJ process. Its very discouraging.

RE: Your article III, section 2 quote specifies differences between when a crime occurs within a state, which DC is not, or somewhere else. But the 6th for similar subject matter says “jury of the state and district wherein the crime was committed. Can I presume the 6th thus modifies the earlier Article III §2 language? In any case, to the extent it’s constitutionally possible Congress should tweak the rules regarding legal actions within DC so that it neither remains a political shield against Democratic corruption nor an opportunity for corrupt lawfare against Republicans.

I want to know what happens when they indict Trump for the fourth time in Fulton County. That grand jury spokesidiot was all over tv shooting off her mouth. I would think Trumps team would have a good cause for dismissal.

Since Trump was still President, he has a legal right to have the Fulton County case removed to Federal Court.

The issue also centers around the rulings made by DC judges, such as the ruling that ordered trump‘s lawyer to turn over his notes.

They indicted him in Florida. They used the grand jury in DC to do 99% of the investigation. By using a DC grand jury, they were able to have an anti-Trump judge rule on issues, such as whether trump’s lawyers had to testify and provide notes to the grand jury. That’s the abuse.

The alleged ‘crime’ occurred in Florida. It really isn’t very complicated. If the grand jury was in FL there would be no indictment, so they had the grand jury in communist Wash DC, which in itself, is being questioned by Judge Cannon as a unethical way to get an indictment.

If they do, she has grounds to dismiss for prosecutorial misconduct and save herself a lot of needless work.

Only problem is it might be for new indictments in DC and New Jersey. She just gave it away. Lol.

the battling judges. is like a living metaphor underlying the battle of helms deep... LOTR reference...
the dems must see a pathway to winning via judge shopping and a ringer or two in related federal and state courts... or they would not be pursuing this crap.

Well if that’s the case, she needs to dismiss the case right now.
