Here's Why Joe Biden Can't Pardon His Son

It has not been a good week for the Biden White House. The evidence of wrongdoing from their alleged bribery operation hasn’t been refuted or disproven. Hunter Biden’s sweetheart plea deal got tossed by a judge who apparently saw it as a perversion of justice. Hunter was about to plead guilty to gun and tax evasion charges and get no jail time. It was a crock. 

Spencer wrote today that more unethical activities were uncovered through new emails, where Hunter wanted a $2 million retainer to recover frozen Libyan assets in 2015. The emails were sent among Democratic donors, who mulled the proposal due to Hunter's access to then-Vice President Joe Biden.

Leah added that Hunter is also being investigated for being a foreign agent by the Justice Department, which law professor Jonathan Turley said is a charge the Biden White House fears most. Turley added that pardoning Hunter remains the “break-the-glass” option regarding this emerging scandal that could detonate the Biden presidency. Ironically, Biden signing the pardon can only end with the end of this administration, which is why this White House is never going to do it: 

The collapse of the Hunter Biden plea bargain has left many in Washington shocked. After all, this is a city that knows how to fix a fight. After five years, the Biden corruption scandal was supposed to die with a vacuous plea bargain and no jail time. Most everyone was in on the fix, from members of Congress to the media to the prosecutors. The problem was the one notable omission: Judge Maryellen Noreika of the U.S. District Court for the District of Delaware. 

The sentencing hearing was a moment that made the Hindenburg disaster look like a seamless landing. Noreika asked a basic question on the implications of the agreement, and the entire deal immediately collapsed. 

Now the Justice Department is in a bind. It could not admit in the hearing that Hunter Biden could escape future liability for a host of uncharged crimes. Yet, when a defendant backs out of a generous plea deal, federal prosecutors ordinarily will pursue all of the available charges — and jail time. 

While President Joe Biden once declared, in more colorful terms, that no one messes with a Biden, the Justice Department may now find it has no choice. It could be forced to actually treat Hunter like an ordinary citizen.

A FARA [Foreign Agents Registration Act] charge could further expose Hunter’s alleged influence-peddling operations, with what House GOP investigators say were millions in foreign payments from a virtual rogue's gallery of foreign officials. The Justice Department also would face pressure to seek the same long jail sentence given to Manafort; he was sentenced to 73 months of imprisonment, which included the statutory maximum 60 months for a conspiracy to violate FARA. (That same year, political consultant W. Samuel Patten pleaded guilty to lobbying and consulting on behalf of the Opposition Bloc, a Ukrainian political party, and received 36 months of probation.) 

That is not even including potential felony charges for the original gun violation, money laundering, or other crimes. If the Justice Department were to show the same aggressive effort toward Hunter Biden that was shown to figures like Manafort, Hunter could be looking at a real possibility of years in jail. 

There is, however, the ultimate "break-the-glass" option that I raised previously if the Bidens and their supporters could not rig the process: Joe Biden could pardon his son and then announce that he will not run for reelection. 

Turley adds that the pardon would have to include numerous crimes, but the Biden family would keep the millions of dollars they’ve accrued through these schemes. The impeachment threat from House Republicans would be neutralized, as Joe would be heading for the exits in 2025. The media would breathe a sigh of relief not having to comb over evidence of Biden corruption they’ve buried out of loyalty to the Democratic Party. He called it a “happy ending” for all, though that’s not going to happen (via Axios): 

The White House said Thursday that there is no possibility that President Biden would end up pardoning his son, Hunter Biden. 

The big picture: A federal judge on Wednesday rejected Hunter Biden's plea deal on tax charges and said that she wasn't ready to accept the terms of a revised deal. 

The case is on hold for at least a few weeks while both sides submit new materials to Judge Maryellen Noreika. 

President Biden supported his son last month after Hunter agreed to plead guilty to not paying taxes in 2017 and 2018. 

Joe still controls the Justice Department, which has kept his family safe from criminal prosecution for years. He knows he holds the cards, at least for now.

After Biden leaves the white house. Trump should use the civil forfeiture laws to take everything that president bidens extended family has and then have them prove it was not pay offs

IF (big IF) a case does proceed against Hunter, it will be fixed so that he gets off.

One thing I heard yesterday that nobody's talking about is that Hunter Biden essentially confessed under oath during the allocution portion of the hearing.

Part of the process of hearing the plea deal is that the witness has to prove that he knows the charges against him, he knows the things that the plea deal is offering to him, that he describes the crimes that he committed in enough detail to demonstrate that the prosecution had more than reasonable likelihood of proving their case in court, and that he is not being coerced to take the plea deal.

Hunter Biden, as a part of his allocution under oath, described the business deal he was setting up with a Chinese businessman. If was after this point that the plea deal fell apart when the defense and prosecution disagreed on the terms of the deal. This left Biden stuck with having already described his crime under oath and then pleading not guilty.

I don't know how he will be able to have his confession tossed out as it happened under oath in open court in front of the judge, the prosecution, and his legal team.

You make a good point as to what Hunter Biden has said so far. But here’s how I think he’ll get off.

By prosecutorial misconduct.

Four types
What are the four types of prosecutorial misconduct
Failing to turn over exculpatory evidence. Tampering with evidence. Knowingly presenting false witness testimony or other false evidence to a court or grand jury. Asking a defendant or defense witness damaging and suggestive questions with no factual basis.

Examples of prosecutorial misconduct involving improper arguments include:
Asserting facts that are not in evidence.
Misstating laws.
Vouching for the credibility of a witness.
Mischaracterizing evidence.
Discriminating in jury selection.
Interfering with a defendant’s Constitutional rights.
Failing to train subordinates.

It would greatly benefit the Biden crime syndicate to have the prosecutor screw up and have a mistrial . Or if there is no mistrial, and a judgment is found against Hunter it will later be set aside for any number of reasons.

REALITY CHECK.......when a defendant backs out of a generous plea deal, such as the one rigged for Hunter, federal prosecutors ordinarily will pursue all of the available charges — including jail time.

The Biden-controlled Justice Department may now find it has no choice.........it could be forced to actually treat Hunter like an ordinary citizen.

I understand what you're suggesting, but I don't think prosecutorial misconduct will work here.

Another fact that's not been widely reported is that, technically, there are no charges against Hunter Biden; he hasn't been indicted for anything! The so-called "plea deal" was really a back-door pardon since it wasn't tied to an actual indictment by a grand jury, and it gave Biden immunity from "future" crimes, that is, crimes not yet discovered (or perhaps even committed).

To borrow a phrase, the plea deal was an "ex-ante" arrangement.

What Biden himself could do is claim incompetent counsel. Biden could say that he would never have confessed in open court if he had known how flimsy the plea deal was, how unscrupulously the immunity was buried in the diversion program side-deal, and that he was shocked --- shocked --- to find out that his team and the prosecutors were colluding.

Nobody would believe it, but it would have enough cover to use it to wipe this all away and start over. They've been brazen enough to this point, why stop now?

The difference here is that the prosecutors were in on it, too. This was a case of the Biden DoJ working with the Biden defense team to clear a Biden of all charges.

The Bidens even had a mole inside the Delaware US Attorney's Office -- Alexander Mackler. Mackler was a press secretary in Joe Biden's Senate office, legal counsel in his vice presidential office, on the Biden-Harris transition team, and managed Beau Biden's campaign for Delaware attorney general.

Mackler also had several personal emails or texts between himself and Hunter Biden expressing a close, familial, relationship.

I totally understand your skepticism, but I'm not so sure.

I wouldn't be surprised if the Democrats try to craft a "Richard Nixon" moment here, and tell Joe Biden to step down for the good of the party.

Now, what that "good of the party" is I can't say. It could be that they are so sure of their voter fraud machine that they could put a ham sandwich in office (that's YOU, Kamala).

I we WERE to look to Watergate for clues, it's possible to me that the Democrats will see no way out and decide that it's better for their long-term agenda (something Republicans fail at) to amputate the limb and strengthen the remaining parts of the body.

It's not my nature to give Democrats political advice, but here is what I would do here:

  1. The Bidens are a criminal liability. Throw them all under the bus.
  2. Kamala Harris will ascend to the presidency as the first black woman president who slept her way to the top and then threw out her boss to take his job. She will then cite Gerald Ford (the first president nobody voted for, as Archie Bunker once said) and pardon Joe and Hunter Biden for the sake of the nation.
  3. The Democrats will rush to flood the zone with primary candidates to ensure that Harris does not make it to the convention. Hello, Gavin!
  4. At this point, the Democrats will start to lose control of the monster that Bidenstein created. Maybe Andrew Cuomo will decide to run. Maybe Heir Whitmer will run. Chief Warren. Hillary!
  5. At this point, I can't see any further. The clown show will just have to parade before us.

Not really. It can be for any and all federal crimes between date “A” and date “B”.

Or - as in the case of President Ford's Executive Pardon of ex-President Nixon - for "any Federal crimes he may or may not have committed prior to XYZ."

Its actually a best “out” for Joseph Stolen.
