Yet to issue a valid subpoena, there must be an actual underlying crime that is being investigated. Otherwise, the government has no authority to issue a subpoena, and no authority to demand retention of what is subpoenad, and therefore, the destruction is still not a crime.
Everything depends on the validity of grounds for the investigation, which, in this case, simply doesn’t exist.
