"A Dozen NYPD Officers Arrest a Guy Smoking a Cigarette Outside as Rapists and Murderers Roam Free"

So with murder, rape, assaults, burglary, and shoplifting running a mok in NY, they send twelve police officers to arrest a guy smoking a cigarette outside. In a city in which a guy feels free to ride his motorcycle down the street just shooting random people, the police apparently have their priorities in line.

They get to claim an arrest of a white guy, so they can pad the numbers.

A clearcut case of “smoking while not black”.

> Did not know it was a crime not to have ID on your person if not in a situation that requires [it] … <

I’m not a lawyer, and I don’t play one on TV. But it’s my understanding that the United States is not a “papers, please” country. If you’re driving a car, then yes. You’re supposed to provide a driver’s license, car registration, and proof of insurance.

Otherwise, you are never required to carry ID. And you are never required to identify yourself, unless you arrested for some other reason. In other words, failure to ID is a secondary offense.

Not that most cops care. You’ll get illegally arrested. Wanna sue? The cops don’t care. The city pays, not them.

I think what happened here is he was smoking in an unauthorized location(breaking the law) and was asked for his id for a citation and then failed to give ID. That is when the officer stated he was going down to the station so he could be identified.

Police do what they are told to do.
So do soldiers, but soldiers are smart enough to not do anything immoral or that reflect poorly on their profession.
They go to jail if they violate the UCMJ. Cops have no such system of rules.
Cops can and often do get away with murder.
Our whole problem with cops is they are unionized and lionized. I despise cops. I’d never call one for help, because they are generally more dangerous than the situation I’m in. Despite all their BS about being in a dangerous profession cops aren’t even in the top ten of most deadly jobs in the USA. All they do is cleanup AFTER criminal crimes have been committed they don’t prevent shit.
The enforcement of CIVIL crimes is BS! Smoking in public, selling un-taxed cigarettes, worrying about expired tabs,
or no drivers license are BS civil issues, that people get killed for. Because the Cops can kill and get a vacation before they will be exonerated.

One of the biggest issues with law enforcement today is fewer decent people want to go into it for a career. For most of our nation’s history, law enforcement was considered a very honorable profession and people that were members were highly respected. That’s not the case anymore.

I suspect that you are correct. Unfortunately, the video does not show what happened at the very beginning of this encounter.

Did the cops give him a chance to put out his cigarette? Or did they give him the chance to move another location? If so and he refused, then the cops are in the right.

But did they immediately pounce on him, and demand ID? If so, the cops are in the wrong. They needlessly escalating the situation.

I’m a betting man. I could be wrong. But I’ll bet it’s the latter. I’ll bet that the cops needlessly escalated. If I’m wrong, I’ll eat a bug (Monty Python reference).

So it’s now illegal to smoke outside in NYC? And it takes a dozen or more cops to arrest this dangerous smoker? What a clown show NYC has become.

“Again...where are all the “back the blue” useful idiots? Come on out wherever you are. I’ll wait.”

I’m one, you silly little girl. My local Sheriff and city police do an excellent job of protecting the public.

You have the mind of a child and think because some LE forces operate this way you want to go pick a fight with the rest of us that support our LE.

“So it’s now illegal to smoke outside in NYC?”

Smoking anything is prohibited in most places outside in NYC, but it seem everyone I know in NYC says the smell of pot has become disgusting at all times everywhere and is a health hazard.

"California Walkman" case went to SC. It is not a crime to out and about without ID. Here is an article about that case.

On Patrol Live is an interesting show—while its intent is to show cops at their best since it is live it often shows cops with short tempers—and there is one cop in particular who seems to be high on drugs while on duty. They have been showing less of him lately—and they never let him drive.

That said there are citizens doing lots of really dumb stuff—even if not illegal.

An example of this is talking into their cell-phones while the cop is trying to talk to them.

While totally legal it is a good way to give the cops an “attitude” in a hurry.

I think sometimes they think to after the easy crimes..in lieu of a serious crime.
Back before they removed 99% of the clunkers from the road ..i swear they targeted the junky cars..cause they knew they couldn’t afford lawyers to get out of a ticket.

Look at celebs ..or sons of presidents..who drive way above the speed limit ..while on drugs.. nothing happens.
You on the other hand would in up in jail and pay a sizable fine.
