McCaskill: ‘It Is Just Amazing How Stupid’ Trump Is

MSNBC political analyst Claire McCaskill said Tuesday on “Deadline” that she believed it was “amazing how stupid” former President Donald Trump was.

At a CNN town hall, Trump said, “I had every right to under the Presidential Records Act. I was there and I took what I took and it gets declassified.”

Anchor Nicolle Wallace said, “It’s the classified documents version of when you’re famous they let you do it. It’s ludicrous.”

Trump is so dumb he’s made billions, started no wars, had a great economy, was better for Blacks than Clinton or Obama, helped our 401Ks grow, made the USA energy powerful, instilled fear in dangerous world leaders, and I could go on and on but trying to help McCaskill understand would a major and time-consuming chore.

In accord with the President Trump’s right to all the presidential records is the Presidential Records Act (PRA) of 1978. This is what it says:

"Establishes public ownership of all Presidential records and defines the term Presidential records."

"Places the responsibility for the custody and management of incumbent Presidential records with the President."

"Requires that the President and his staff take all practical steps to file personal records separately from Presidential records."

"Allows the incumbent President to dispose of records that no longer have administrative, historical, informational, or evidentiary value, once the views of the Archivist of the United States on the proposed disposal have been obtained in writing."

This sorting process was what President Trump was in the process of doing. He admitted he had much more to do and was not done before the F.B.I. raided Mar-A-Lago. Is it now a federal crime to be behind in the job? It tells me those running the show for Biden would have no idea how to change a light bulb!

The sorting process was to have been completed before he left office, and the Archivist was to take possession of all presidential records on January 20th at noon. But keep in mind that the only documents Trump has been charged for were the ones that the FBI found in the raid, not the ones he returned voluntarily or in response to the subpoena. And according to the indictment, the search warrant was issued when the FBI found evidence that some of the boxes appeared to have been hidden from the Trump attorneys during their search in response to the subpoena. After the subpoena and Trump’s attorneys certifying that all the boxes had been searched and all documents with classification markings returned, the government will argue that Trump was no longer trying to return the documents found during the raid and was actively trying to conceal them.

There is no specification when the sorting was to be done. Trump had the power to determine what documents he could keep and what documents needed to be kept by the National Archive. You have to realize that the last month in office, President Trump was fighting another fake impeachment for “incitement of insurrection”, stating that he had incited the January 6 attack of the U.S. Capitol.

The problem with your position is that even if you grant everything you say, once the Trump team certified that everything had been turned over, he was no longer trying to sort through and return the documents they were seeking, so that defense no longer applied to the documents they seized in the raid.
