I’ve seen slightly different vote totals reported for this at different sites. I haven’t seen any republican reported as voting against censure, this time, just some reported as voting “Present” and some not voting at all. I also haven’t seen any Democrats reported as voting other than against censure. Although the vote totals suggest there are currently more open seats than I’d expected or some Democrats also didn’t vote. Censure doesn’t do much, as is often noted, but it does gain the censured a referral to the Ethics Committee for, potentially further investigations and conceivably from where a motion for censure could start. One report claimed 5 GOP members of the ethics committee were among the five or six who voted Present. It hypothesized that so voting there might be part of a strategy anticipating future actions at their committee. I don’t know whether that is true, but perhaps some attempts at so explaining the present votes will occur. At least this time Censure was accomplished; by how many votes is of relatively little matter. In the previous attempt to censure 20 GOP members voted to table it. IIRC the only one who tried to explain those votes was Massie. Wqqho said he doubted the $16M fine included was constitutional. Much as I’d love to see Schiff expelled out of congress and then put in jail I can’t recall ANY case where Congress has censured AND fined a member previously, nor any fines levied by Congress against those few members who’ve actually been expelled. And I do recall the Constitution barring Bills of Attainder. But then I can’t claim encyclopedic knowledge of congressional disciplinary actions, and as a non-lawyer perhaps Bills of Attainder don’t mean quite what I thought they did. But it’s conceivable Massie’s doubts were correct and in sync with his, oft here applauded, reputation for honoring the letter of the Constitution. And if so, voting to table the prior motion, voting for censuring him this time, and potentially voting to expel him on some future vote , even if we can’t reach the needed 2/3 to boot him, should be the desired MAGA course. If there is indeed no precedent for Congress fining its own members, then if a fine were morally deserved it should be accomplished not via congressional fiat, but rather by congressional referral to exec branch Justice to charge him and then judiciary branch for trial.
