New Trump indictment over documents is a 'whole different ballgame,' says Jonathan Turley

Fox News contributor Jonathan Turley joined "America's Newsroom" to discuss how the new indictment over classified documents will look different from the Manhattan indictment for President Trump. The constitutional law professor said the Alvin Bragg prosecution is "political" but says the Miami indictment is a "whole new ballgame."

PROSECUTORS UNSEAL CHARGES AGAINST TRUMP IN CLASSIFIED DOCUMENTS CASE, INCLUDING OBSTRUCTION OF JUSTICE

JONATHAN TURLEY: I know a lot of people have criticized [Jack] Smith for his background, but he's no Alvin Bragg. He's a serious prosecutor. The Alvin Bragg prosecution is a political prosecution. It is what Trump says it is. It is a weaponization of the criminal justice system, in my view. This is a different ball game.

After the indictment was unsealed Friday afternoon, Turley said on "America Reports" that the charges laid out are "extremely damning."

TURLEY: It is an extremely damning indictment. There are indictments that are sometimes called narrative or speaking indictments. These are indictments that are really meant to make a point as to the depth of the evidence. There are some indictments that are just bare bones. This is not. The special counsel knew that there would be a lot of people who were going to allege that the Department of Justice was acting in a biased or politically motivated way.

This is clearly an indictment that was drafted to answer those questions. It’s overwhelming in details. And, you know, the Trump team should not fool itself, these are hits below the waterline. These are witnesses who apparently testified under oath, gave statements to federal investigators, both of which can be criminally charged if they’re false. Those witnesses are directly quoting the president in encouraging others not to look for documents or allegedly to conceal them. It’s damaging.

These seems to be the only responses President Trump has made to the items in the unsealed indictment. Has he responded to the alleged recording of him saying he did not declassify?

When the FBI raided Mar-a-Lago, they wouldn’t let my lawyers or representatives anywhere near them. They wouldn’t tell us what they took. Knowing them, and based on past performance, they probably later “stuffed” in other documents. My lawyers had to wait outside, on a very hot day. The FBI took my medical records, birth certificate, and passports, and just about anything else they were able to get their hands on. What a group! They didn’t do this to Crooked Joe Biden or Hillary.

The indictment refers to Mar-a-Lago in the past tense.

Start from there and tear the indictment apart.

Turley’s persuaded by language. They could of wrote the same about Hillary and worse, but they didn’t.

Hillary ignored regulations and used unencrypted cell phones in Russia, China, and many countries. There was actually penetration with her illegal server and email system. Hillary also sent Classified Docs in the wind because her team forwarded them on open, public systems.

If there was a Espionage Act charge, old Hillary that sought bleach bit of her systems that advertised cleaning to best forensics testing and tools. Forensics as is Crimes, Criminal court.

And yet security at Mar-a-lago was tight enough to keep Chinese spies out, something we cannot say for the Biden White House, for Hunter Biden’s rentals, for Feinstein’s office, etc.

He’s a expert on the Constitution....a Constitutional scholar..... a law system parasite.

Who knows what documents they stuffed in after they collected it?

They could have done anything they wanted since they didn’t allow Trump’s lawyers to take inventory as they loaded it up.

All the “evidence” should be thrown out for that reason alone.

You do believe in verifying “evidence,” don’t you?

The whole thing was a set up lke Jan 6th. They knew classified was mixed in and they let him take it to Mar-A-Lago instead of a secured site like every other departing POTUS.

A legislative solution by Congress is required to prevent the DOJ from continuing to conduct ham-handed criminal investigations of matters that are not inherently criminal.

Pg. 1, Footnote 1:

The purpose of this letter is not to opine about whether these documents are actually classified or have been declassified, but retain their classification markings. Despite our requests to DOJ, it has refused to tell us whether in its judgment any of the documents remain classified. Similarly, DOJ has refused to allow for inspection of the documents at any time during the last eight months despite the fact that one of our attorneys has sufficient clearance to view the majority of the documents marked as classified.

When President Trump left office, there was little time to prepare for the outgoing transition from the presidency . . . White House staffers and General Service Administration ("GSA") employees quickly packed everything into boxes and shipped them to Florida. This was a stark change from the standard preparations made by GSA and National Archives and Records Administration ("NARA") for prior administrations. As NARA acknowledged in a Press Statement it issued on October 11, 2022:

The National Archives and Records Administration ("NARA"), in accordance with the Presidential Records Act, assumed physical and legal custody of the Presidential records from the administrations of Barack Obama, George W. Bush, Bill Clinton, George H.W. Bush, and Ronald Reagan, when those Presidents left office. NARA securely moved these records to temporary facilities that NARA leased from the General Services Administration ("GSA"), near the locations of future Presidential Libraries that former Presidents built for NARA. All such temporary facilities met strict archival and security standards, and have been managed and staffed exclusively by NARA employees.

[bold, mine:] NARA unfortunately has become overtly political and declined to provide archival assistance to President Trump's transition team . . .

[NARA] did not take custody of the documents and this made necessary the transfer of boxes of documents to President Trump's heavily secured home at Mar-a-Lago. To be clear, had NARA offered President Trump the same assistance that it had provided to all previous Presidents, he would have accepted the offer and there would have been no reason to transfer the documents to Mar-a-Lago.
