Fox News Wednesday notified Tucker Carlson's lawyers that the former prime-time anchor violated his contract with the network when he launched his own Twitter show on Tuesday, according to a copy of a letter obtained by Axios.
Why it matters: A breach of contract claim sets Fox News up to explore potential legal action against Carlson, a move that would intensify the already thorny public battle between the two parties.
Carlson’s lawyers told Axios that any legal action by Fox would violate his First Amendment rights.
“Fox defends its very existence on freedom of speech grounds. Now they want to take Tucker Carlson’s right to speak freely away from him because he took to social media to share his thoughts on current events," said Carlson's lawyer, Bryan Freedman, in a statement to Axios.

A contract is a contract. Dumb lawyering is a preventable blunder. For example, Taylor Swift's parents hired stupid lawyers who failed to negotiate with Big Machine Records to retain her ownership rights for her own music. So after BMR sold those rights to Scooter Braun, Swift had to go and re-record every single one of those songs to retain royalties. OR her parents could have just gotten better lawyers, or signed with someone else. Tucker is a big boy, and knows what he signed.
FOX looking for more bad publicity regarding Tucker.

Last I checked his Twitter video had 67 million views. Fox pulled what, 3 million on a really good night? No wonder they’re scared.
Not true. The Twitter platform was not mentioned in his contract. Supposedly only cable and network were mentioned.
That would be because FOX failed to see Twitter as a viable option.
I figure Tucker went ahead with this on purpose to have it out with FOX now, so he cold get back to work.
I have also heard he has one of the best contract attorneys in the country.
Fox will learn what our First Amendment protects.
It will be a costly lesson in $’s and in market share!
They fired him with the agreement that they would compensate him monetarily. The no compete clause in his contract gives them a out on that compensation. This might end up being a win/win situation for Tucker.

Fox dumped him to keep him silent until after the election.

Now he can use Twitter without violating non-compete.
Fox of course will sue, even if they know they are wrong and can’t win.

How is it that Tucker is no longer able to post his own opinion on his own, personal Twitter account? Is anyone who once worked for Fox News no longer allowed to give their opinion on their Twitter account? Wow. I had no idea you gave up your right to free speech when you signed up with Fox.
It's no different than an NFL coach who is fired from his job with two years left on a contract that pays him $5M per year. If the team pays him for the remainder of the contract, they can enforce the non-compete clause and prevent him from coaching elsewhere in the NFL.
In Carlson's case, the problem FOX has is that they'd have a hard time demonstrating that they've suffered any damages if he breaches the contract. They'd just have the contract canceled and wouldn't have to pay him.
Say what?
It will all depend on whether Tucker received payment for his Twitter monologue.
If he did not get money for it, he was just giving his private, First-Amendment-protected opinion.
Fox already breached their contract with Tucker when one of their execs defamed Tucker, by releasing internal video.
