A New York City woman who admitted she showed up to work late dozens of times in less than a year has been awarded millions of dollars by a jury after she successfully argued in court she was terminated because she is black.
Jurors in the case did not view dozens of instances of tardiness as a reason for separation from the company.
The New York Times reported a woman named Röbynn Europe sued a company called Equinox, which operates a number of high-end fitness brands and gyms.
Europe alleged after she was fired from her job on New York City’s Upper East Side that her 10 months with the company left her feeling targeted over her skin color.
In a complaint filed in Manhattan federal court, she argued she had been subjected to a hostile work environment.

The plaintiff did not dispute her attendance record at work but argued the company ultimately sacked her over her skin color.
A New York jury of five women and three men, most of whom were white, agreed with her and ordered her former employer to pay her more than $11 million — $10 million in punitive damages and an additional $1.25 million to compensate her for her distress.
Europe also said being fired contributed to the worsening of an eating disorder she had already struggling with.
Equinox said it does not tolerate discrimination in any form and said jurors bought into the “sympathy and emotion” Europe brought to the trial. Attorneys intend to challenge the damages assessed.
The company also called the ruling “extreme” and “unconscionable.”

I used to work in a black-owned small business, where many of the owner’s nieces and nephews also worked, and more than once I was told that they’re not late, they’re on C.P.T.

Unless the company demanded its day in court, it’s the company’s attorneys fault for not settling. They know where they are and what the juries look like in NYC. Just the cost of doing business there.

As an aside, if a consulting agreement is used, make sure there is a firewall between the consultants and the main company (i.e., use contract workers who indemnify the main company and make them get insurance to back up that indemnification).
So the two tier US justice system now not only benefits Democrats but also some blacks who pretty much do what they want and then scream racism or reparations and hold out their hands to collect the goodies.
Perhaps the defendant refused to settle or offered to settle for $11+-million because she knew she could win big.
I lived or worked in NYC for over 40 years. Can’t pay me enough to go to the city.

This gal is a thief. She stole (time) from her employer. I wish the answer was as simple as “just don’t hire these people in the first place.”
But Affirmative Action laws wouldn’t allow for that.
I guess employers have to factor in employee theft like this in the same way retailers have to allow for shoplifting.

One thing you can say about American cities…they’re the next best thing to Mogadishu.
Assuming the decision isn't overturned on appeal, it will probably be a long time before she sees any money. Once the cash flow starts, I don't doubt that she can squander it in a year. Her attorneys and the government will take most of it right away.

Hmm, I’d say a high-end fitness chain hiring a black woman with an eating disorder is pretty good evidence they were probably bending over backwards to not appear racist.
