A 65-year-old man who was the victim of an attempted early morning mugging in Queens is now facing charges after he allegedly shot his attacker to death.

He’s not charged with murder, by the way. He’s charged with CPW. Not ideal, but he will most likely do no time.
Queens District Melinda Katz charged Foehner with criminal possession of a weapon and a firearm. Investigators revealed he had a license for a shotgun and a rifle, but not for his pistol, and he did not have a concealed carry permit. Police said Foehner has no criminal history.

This is possibly a 2nd Amendment case. The murder charge is dependent on a gun charge; viz., that the 65-year old didn’t have a license for his handgun. But, who in New York City can actually get such a license? The Supreme Court allows guns to be regulated, but says the Constitution protects the right to own. Turn “regulation” into an effective prohibition and you violate the Constitution.

Note the “allegedly” — we don’t know all the facts yet.

I’d suggest we learn more before drawing conclusions
I see that as the punch line in a Larson cartoon.
CPW = Criminal Possession of a Weapon, for those who don’t want to click thru. I broke FR tradition and did so.
That is interesting. This would seem to be a great case to test the Constitutionality of that law.
The Supreme Court overturned the NYS concealed carry law. Not saying it’s easy to get, but it’s easier then it was before.
Lesson from this: Should have been open-carrying his shotgun.

If the 65 year-old man voted for a Democrat anytime since 1980 he deserves it.
In NY, you are not allowed to defend yourself. You are just obligated to be injured and/or die, and let the criminal have his way with you, without consequence to him.

Well, at least if he’s going to have to do jail time, he made it worth it by removing the feral from the gene pool.

Seems like the charges are appropriate.
Now whether you believe you should need a license for a firearm is a different discussion. Honestly I don’t see how you need a license to exercise a right, but the laws are what the laws are.
Read the actual article... he’s not being over killing the man.. The charges are around not having a license for the firearm he used.
Now, I don’t agree that you should need a license to exercise your rights, but until such laws are declared unconstitutional, they exist. Charges seem correct.

Welcome to the ‘end times’...where evil is good and good is evil.
He was charged with “gun violations”, meaning he exercised his Constitutional rights.
They should be giving him the key to the city, if anyone can remember when that used to be done!
