Good for this old gal. I hope the court allows her to charge the same interest and penalty’s accrued over the last 10 years as the city did.
Judges are paid through taxes and forfeitures too. They need to keep those retirement accounts well funded.
The word “unanimous” is a clue.
Ridiculous it even got that far. I am glad she lived to be vindicated and I am also glad it was a unanimous decision. Government has gone amok!
Wealthy people using evil government to prey on poor people.
We have criminal government.
In Oklahoma, the county can auction off a property for back taxes. In our town alone, there are hundreds of houses that have been obtained like that. And they’re usually low value houses that are then used as rentals by the person who makes the highest bid. Often, the back taxes owed are no more than a couple of thousand dollars. Or sold on a “rent to own plan”, which often falls through, due to the buyer not being able to afford the monthly payments. Then the owner turns around and resells or rents it to someone else. It’s legal, and since the taxes here are ridiculously low (our taxes on our little 1000 sq ft house are only $200/yr), it’s usually just someone who has abandoned the house anyway.
“accrued a $2,300 tax bill, which turned into an approximately $15,000 bill after the government added on $13,000 in penalties, interest, and fees. “
I deal with this—
$2,300 PER YEAR!- don’t pay?
penalty AND interest-
THIS IS ADDED on to next years TAXES-
YOU get 5 years AND Multiple letters- and process servers
THIS is how you accumulate $15,000 in arrears to the GOVT.
I had a family member do this— no Kidding- the family came
together to pay the amount— 1 year later she is doing the
same thing... mental case- (has money to smoke and drink though) no we won’t be bailing her out a second time
The government violated the Constitution
My how the things have grown sense 2020.
Strange...just the other day they ruled that a guy who was the victim of “civil asset forfeiture” couldn’t get his money back. No charges filed against him...no convictions. They just stopped him on the highway and took his money claiming it was the proceeds of drug dealing.
Even if she did owe a mortgage, that price gain is hers!!!
There are lots of near paid off mortgage’s and properties with large equity gains, where an elderly person becomes unable to work or pay bills.
This ruling is going to restore faith in the idea of home ownership!
The gubment might seize your home, but they must return to you any excess proceeds from the sale.
This will chill gubments from preying on homeowners, now that they need to pay up any Ill gotten gains with interest!
The ruling will have lasting impact for next 100 years.
Well said.
Dem run city?
Maine does this and gov. Lepage could not get it overturned. The towns loved it.
My mortgage company paid the property tax on my home. My last payment was in the middle of the yr. unknown to me, they only paid half.
Every yr I got my tax bill but there was no mention of back tax owed. I didn’t know until a few yrs later when a sheriff’s deputy showed up to hand me a notice they were going to sell my house for back taxes owed and I had 30 days to pay to prevent it from happening.
I paid.
They never added back taxes or penalties on my tax bill. I had no idea I owed until a deputy showed up and said I had 30 days to pay or vacate
Yeah, Maine is blue enough that I expect it from Maine. Other states include NY, NJ, Mass, Minn, Calif, Ore, Col,... the usual suspects.
“Even if she did owe a mortgage, that price gain is hers!!!”
She had no equity. Why should she get a bonus?
Well, in fairness to Alabama, our property taxes are the second lowest in the nation.
So most homes only have an annual $2-300 tax bill.
You’re in a world of hurt if you can’t pay that. In fact, most people can go to their church and the church will help them pay the tax if they really can’t afford it.

Same for “civil asset forfeiture”
So glad the USSC finally put an end to it.
