‘A tragic story’ State troopers capture criminal but shoot his hostage

ATLANTA, Ga. (Atlanta News First) - A federal appeals court has ruled police can shoot hostages — even intentionally — if they fear for their lives or to stop a fleeing felon.

The case is more than just a legal footnote to Don Davis. The Georgia truck driver was shot nine times by troopers and deputies who were trying to stop a murder suspect holding Davis hostage in his truck.

While the shooting occurred in 2015, the U.S. Supreme Court just this week let stand a federal court ruling that police owe the hostage nothing for his medical bills or the lasting effects of the officer-inflicted gunshot wounds.

The police have never had a duty of care. Read the case law involving that question.

The police had every reason to believe they were targeting the fugitive. The police were told the fugitive was driving the truck and they targeted the driver of the truck. Instead the fugitive was on the floor of the truck. IOW, mistaken identity.

Dispatch informed several officers that the hostage was driving. Some police didn't know, they said. Judge stated the some officers allegedly knew the hostage was driving; still a threat, even as a hostage and deserved to be shot.

Uh, so, wait a minute, he was told by a former employer, if you ever, you better never get a job where you have influence over others, an authority position, or I’ll do whatever it takes to stop you. So wouldn’t becoming a cop kinda give him the ultimate authority over people?

Dr. Cole: Well, you know, lucky for all these other people, he kept moving from county to county so they weren’t really, uh, yeah, it is the ultimate authority he was just moving around so people wouldn’t know what he was doing, and I think getting out of the teaching profession they didn’t know what he was going to do.

He eventually applied to the Broward County Police Unit; he was rejected, though, because he failed the psychological test.

Eric Olsen: Oh that’s it he’s out of the career. No career for him He’s obviously unstable…

Dr. Cole: One, you know what? One would think so, and I actually used to perform these psych tests, and oh, do I have stories! You would think that it would even, it’s supposed to, let me tell you how it’s supposed to work, it’s supposed to prevent you from getting a job as a police officer or a prison guard.

Eric Olsen: Sure.

Dr. Cole: Does that always occur?

Eric Olsen: I would hope that it does.

Dr. Cole: No, no, no, I would say 50% of the time.

Eric Olsen: What?

Dr. Cole: It’s supposed to be a be a requirement, a REQUIREMENT, if you don’t pass, if you are not psychologically fit, you are not supposed to become a police officer or a prison guard. Does that actually preclude you from becoming a police officer even as long ago as what, 2005? No, I was doing them in 2005. Half of the people I rejected still became a cop.

I believe there was a court case in Indiana that allows a citizen to shoot a cop under certain home self defense circumstances.

C’mon...During the summer of 2020 leftist riots, innocent people were being assaulted en mass, on video, right in front of the cops, who did nothing to stop it.

Topeka KS case. Cops went into wrong house. Cop at door gets killed. Cops said they announced “police-search warrant”. 3-4 neighbors said, they didn’t. Audio recording nearby proves police lied. Guy got off. Cops retaliated acquittal with following this guy around and giving tickets to his wife and adult son. Moved away after a year. Successfully sued. Circa early 90s.

All the county and state had to do was pay the man’s medical bills and make it right with him financially.

How much did it cost the county and the state to take this to SCOTUS?

I note that Davis’ attorney worked pro-bono - not all lawyers are jerks!

A new law likely makes Indiana the only state where people are allowed to shoot cops under certain circumstances. The change, police officials say, not only puts officer’s safety at risk but the public’s too.

Thirty eight comments and not one with the idea that police were never in the public protection business. That’s a mafia endeavour. Police tape off the scene, draw pictures of the crime scene, and begin an investigation.

With apologies to the Policeman who took out the Allen Texas shooter before he took out a hundred people.
