NASHVILLE, Tenn. (WKRN) — He may have been expelled Thursday evening, but Justin Jones is back in the Tennessee House of Representatives.
The ousted legislator was reappointed to his former seat in the 52nd District in Nashville by the Metro Council Monday afternoon, two business days after he was officially expelled from the House for breaking decorum rules on the House floor March 30.
Jones faced expulsion along with fellow Democrats Gloria Johnson of Knoxville and Justin Pearson of Memphis. Johnson survived the expulsion vote by one, but Pearson was ousted as well Thursday. The move was met with national criticism of Republican leaders in the state house, including House Speaker Cameron Sexton.
Shortly after the expulsion, Metro leaders were quick to announce their support for Jones and intentions to send him back to House. Vice Mayor Jim Shulman quickly announced a special called meeting to announce the vacancy, as required by law.

A legislator who participated in a non-violent protest in the state capitol.
I don’t see how the Metro Council can assign someone to the State of Tennessee House of Representatives.
I mean, they can say, “Here’s who we nominate for the seat”, but it seems it would be up to the legislature to accept or reject that nomination.
I don’t think they can do that by the Tennessee Constitution.

GOP should have anticipated this.
I guess they didn’t think anyone would dare secondguess Kevin McCarthy.
This is a state legislative seat, not a Congressional seat. McCarthy has nothing to do with it.
Metro is commie as hell. This is against the TN Constitution.
Says they must choose a “successor “ though he could run again in a special election or next general election.

What does Kevin McCarthy have to do with this?

The simple answer is refuse to seat him. He was expelled for cause, that cause is still valid. If the legislature lets him back in then their authority has been usurped. It’s no different than ignoring a judge’s order and the judge just saying OK. You’ve got to enforce your order or you have no legitimacy.
Escort him out of the burring and secure his office.
