I doubt the president did his own accounting. As Jarret or Dershowitz says, who reveals in a public record and NDA. The whole point is not to disclose it.
If the NDA is legal, then the non-descriptive entry must also be legal.
It was his company, sole owner? Was he defrauding himself?
What is the crime he was covering up? And why not charge for that crime? Is that charge pending?

The Eighth Count is for what Cohen did. They would have to prove instruction by President Trump beyond a reasonable doubt, using The Rat's testimony -- a known perjurer in the same Manhattan court! Who rarely followed Trump's instructions, according to reams of his own prior testimony!
No, this guy Boogums is just a blackface Nifong. Nifong served time, was disbarred, lost judgments against him, and declared bankruptcy. He lives a solitary life in the North Carolina woods and refuses interviews.

If he wasn’t in charge of the company at that point (and he couldn’t be), how can they charge him for acts he could not control?
The indictment itself identifies that date that the action underlying each and every count occurred. the latest are in 2017, i.e., over 5 years ago. I thought they might try to say that Trump’s tax returns were filed later, thus extending the SoL. But no counts relate to tax filings — just invoices from and and payments to Cohen.
Maybe I’m wrong, but I believe that the “extension because couldn’t serve a missing defendant” concept requires that an indictment exist that the DA was unable to serve, despite best efforts.
The killer fact here is that NO INDICTMENT EXISTED until a few days ago. Once an indictment was created, it took just a few days for Trump to turn himself in. If someone thinks a case for extending the statute of limitations can be made out of this, please explain how.
Exactly who was defrauded by characterizing payments to Trump’s attorney as legal expenses is not identified. Looks to me like the easiest case for dismissal ever. The judge should sanction Bragg and order him to pay all Trump’s costs.
It definitely seems like their is a problem with the statute of limitations.
Not only that, but per the DOJ plea deal with Cohen, the Trump Foundation recorded the expenses as "legal expenses". Paying your lawyer to execute an NDA is certainly a legal expense. The DOJ's only claim was that these expenses occurred in 2016, not 2017. An absolute crock.
"The Company (Trump Foundation) accounted for these payments as legal expenses. In truth and in fact, there was no such retainer agreement, and the monthly invoices COHEN submitted were not in connection with any legal services he had provided in 2017.
Counts 1 thru 7 are time-barred due to be past the statue of limitation. Plus, they are not charging him with another crime but I guess it’s a felony to write a check to your lawyer if you are republican.
They knew where he was the whole time. 1600 Pennsylvania Ave. This is such a stretch because these are state charges not federal.
The only thing that concerns me is that the judge wants this to go to trial. We saw with Gen. Flynn that a case that had no merits still went through the courts, even after Trump pardoned him!
I just wonder how many layers of courts will this have to go through before it reaches a judge with enough common sense to put this thing to rest.
