Former President Trump’s legal team makes a significant announcement against Manhattan DA Alvin Bragg’s “politically motivated” indictment against him.
On Sunday, Trump's attorney Joe Tacopina expects to make a motion to dismiss any charges against the former president.
“We will take the indictment. We will dissect it. The team will look at every potential issue that we will be able to challenge and will challenge. And, of course, I very much anticipate a motion to dismiss coming because there's no law that fits this," Tacopina said during an interview on CNN.
The Trump lawyer said his team would not do anything at the arraignment because that would be “showmanship.”
The indictment of Trump will be sealed until he appears at an arrangement hearing, which is currently scheduled for Tuesday. He also said he had no reason to believe the judge assigned to the case has any bias.
“And you have a situation where, you know, the federal government, the Department of Justice, turned this matter down," Tacopina continued. "The FEC, which governs federal election laws, said there's no violation here. Yet somehow, a state prosecutor has taken a misdemeanor and tried to cobble together to make it a felony by alleging a violation of federal campaign violations. And the FEC said that doesn't exist."
Tacopina said that whether you are a Trump supporter or not, a Republican or Democrat, the fact Trump was indicted over such a flimsy event should bother anyone.
“This should really shake the core of what we believe our justice system should be about. It should not be weaponized to go after political opponents,” he said.

Well, that’s optimistic given what I’ve otherwise heard.
I think he’s just putting the good judge on notice.
Their first move should be a change of venue motion.
President Trump said this judge hates him. The judge looks a bit light on his feet. He’s also made prior poor judgments. I suspect he’s the “chosen” one for this political hit job…chosen by the power entities who must take out President Trump to have their way with the United States of America.
Alan Dershowitz believes the case will be dismissed.

That’s what I’ve been wondering. How can they prepare without seeing the indictment?
Glad that the Trump team has decided to take a very measured look at all of the (flimsy, BS) charges and respond in a proper manner according to standard legal procedures. There are times at which showmanship of some type is necessary or desirable - and this isn’t one of them.
This is PURELY political - if paying someone a sum of money as a settlement is illegal, then literally half of Congress, most entertainers and many in professional sports would be in the Graybar Hotel. Those very public jobs are a magnet for scumbags looking for a big payoff and/or their 15 minutes in the limelight, and a settlement is oftentimes the most practical solution for the public figure - as distasteful and aggravating as it must be to pay scumbags for the bogus accusations.
This should not be a partisan issue - because assuredly the shoe will be on the other foot someday...someday it’ll be a scumbag Republican prosecutor doing this to some Democrat, and it will be equally unjust for that person to go through what Trump is going through right now. I am disappointed (not surprised, mind you, just disappointed) that some of the senior Dems with some experience didn’t come out and publicly condemn this nonsense. The very idea of a former President who is running for office being subjected to criminal proceedings is anathema to our political system, let alone when the incident at issue took place so long before and in which multiple other potential prosecutors looked at it and decided that it was a nothingburger.
As for Alvin Bragg, he deserves a nice Yiddish curse: “May he eat like a horse and $hit like a bird.”
Agree. Malicious prosecution should be persued but after either aquittal or it is tossed.

The judge will deny the motion as well a change of venue motion. Trump should have arranged a cadre of some top constitutional lawyers to defend him. They should attempt an emergency appeal directly to the Supreme Court.

Probably because Trump (or his lawyers) know that DeSantis has no real legal means to resist extradition. He might say “no” at first, then he would get a court order from a federal judge, and the choice would be, either hand Trump over, or DeSantis gets arrested and Trump gets handed over anyway.

Well, there’s zero chance that would work. You can’t appeal a case before it’s been adjudicated, much less before the arraignment. Even then, they would have to appeal to at least the highest court in NY state and get rejected before they could try to skip straight to the SC.
The only other way it could happen is if the SC steps in and declares the case is in their original jursidiction.
