Previously unseen footage shines a spotlight on Attorney General Garland’s duty to disclose evidence in possession of the government.
Attorney General Garland, in the wake of the disclosures of footage from government cameras showing the “QAnon Shaman,” Jacob Chansley, being guided through the Capitol by uniformed police on January 6, 2021, has an obligation to bring, if he hasn’t done so already, the evidence to the attention of Chansley’s lawyers and the court.
That is the opinion of one of America’s leading defense lawyers, Harvey Silverglate of Boston.

Suspect - don’t know - that a guilty plea entered when there was exculpatory evidence withheld would be an invalid plea. People DO plea to get the best possible outcome even if they are innocent. If they can’t give a solid case because the GOVERNMENT, which in not just the DOJ, withholds evidence that would clear them, then yeah: You take the best you can get but it is due to government malfeasance.
If there was any justice, every judge that agreed to let them be tried in DC would be put in jail themselves. But there isn’t. The US justice system has become an evil joke.
Writ of Habeas Corpus based on the knowing and intentional failure to disclose exculpatory evidence (that was already in the Govt’s hands)
They tortured them into pleading guilty to get Trump!
I don't think that holds up. Remember, they dropped charges against Daniel Ellsburg, because to prosecute him they would have had to release classified material in discovery.
The DoJ has been using the "methods and sources" excuse to block everything that might have been exculpatory for President Trump.
The Pentagon Papers isn't even on the same planet as the J6 breach of the Capitol. They won't blink an eye about Conan.

Has the law changed?
Julie Kelly, the go-to gal on everything J6, appeared on WR with Bannon just now.
She said that Albert Watkins, Jake’s original attorney, has come forward to say he had not been given video that was shown on Tucker.
Violates Brady.
YES! This!
We are so lucky Merrick never made SCOTUS.
Also, are you aware that there are many critics who say that too much is being classified in order to protect the politicians?
Also, should we consider the Capitol Police to be protected intel assets and basic Capitol policing to be secret methods when thousands of people are touring the grounds each and every day?
-PJ
This is why pleading guilty is dangerous....no appeal.
The videos were withheld in order to facilitate the political trials. Combine withholding of exculpatory evidence with DC juries and far Left judges and you can convict anyone of anything and frighten the opposition into silence. These trials are a direct threat to dissidence from proclaimed government orthodoxy.
Sure seems like it.
Excellent point
Hahaha
Its called “Brady
Material.” The prosection’s failure to disclose is reversible error.
Are the DC judges going to follow the US Constitution now? Disbarment for them would be a good remedy, but “national security!”
