Former Judge Accuses DeSantis of Violating the U.S. Constitution

Florida Gov. Ron DeSantis is being accused of violating the U.S. Constitution and Florida law by former Judge and Fox News Contributor Andrew Napolitano.

Judge Napolitano made the accusation against Gov. DeSantis on Twitter and Tik Tok after a video was posted by conservative activist and journalist Laura Loomer showing herself and a group of Trump supporters from TheVillages being told to leave the parking lot of the bookstore where DeSantis was having his book signing event.

“That’s absolutely prohibited by the Constitution of the United States. Moreover, Florida has a public accommodation law,” said Napolitano.

After posting the video on his Twitter and Tik Tok accounts, Napolitano continued, saying that Florida law does not allow for anyone to be discriminated against “on the basis of their politics.”

“You cannot discriminate against people on the basis of their politics. That’s Florida law. So, the Governor, or his people, he’s going to claim he didn’t know about it, directly or indirectly violated the Constitution he swore to uphold, the First Amendment he swore to uphold, and Florida law he swore to enforce,” concluded Napolitano.

Loomer posted the video on Twitter, accusing Gov. DeSantis and his staff of being ignorant of the U.S. Constitution and Florida law.

The incident occurred Tuesday, February 28, 2023, on the first day of DeSantis's book release, during a stop on his book tour at Books-a-Million bookstore in Leesburg, Florida.

Loomer, who supports former President Donald Trump’s 2024 presidential candidacy, has been relentlessly attacking DeSantis over what she calls his "failed" Big Tech censorship bill and his recent encouragement of the Florida Legislature to change Florida's “Resign to Run” las so that he can keep his job as govenor, and primary challenge President Trump in 2024.

That measure to change the "Resign to Run" law is expected to make its way through the Florida Legislature when session begins next week.

In the viral video she posted of the incident, a security guard is seen and heard telling Loomer and her group to leave.

“The (Team DeSantis) told me that anyone wearing Trump has to go right now, during the signing,” said the security guard.

The guard continued, saying, “DeSantis people are in there saying, to have me come and tell you guys not to be here while he’s here.”

Loomer asked, “So DeSantis’s people told you we have to leave?”

The guard responded “Yes.”

The Floridian spoke to the DeSantis team and they reassured us that they did not tell the guard to tell Loomer and the rest of the Trump supporters to leave, even though the secruity guard is on video repeating the accusation several times.

DeSantis’s team had no further comment.

DeSantis will be in Texas this weekend speaking at events in Dallas and Houston (for a Club for Growth Club Meeting), and will not attend CPAC, as The Floridian first reported.

Wait... is Judge Napolitano REALLY saying that a private business cannot hold a private event, and what’s more, that the Constitution denies them the right to do so?

Napolitano is at least flat-out wrong about Florida’s public accomodation law, which makes no reference to political persuasion, let alone establish a right to carry banners and campaign placards into a private establishment. Here’s the actual law:

760.08 Discrimination in places of public accommodation.—All persons shall be entitled to the full and equal enjoyment of the goods, services, facilities, privileges, advantages, and accommodations of any place of public accommodation, as defined in this chapter, without discrimination or segregation on the ground of race, color, national origin, sex, handicap, familial status, or religion.

So is Trump going to heel his attack dog for making outrageous legal assertions?

And by the way, “The Floridian” is fake news, by which I mean it’s a web site which is designed to appear to be a newspaper’s website, but does not actually belong to any current or former newspaper or publish news beyond its politicized or agenda-driven focus.

Florida Gov. Ron DeSantis is being accused of violating the U.S. Constitution and Florida law by former Judge and Fox News Contributor Andrew Napolitano.

In addition, Napalitano is accusing Governor DeSantis of groping him in the men’s bathroom at Loves Truck Stop in Roanoak Virginia.

Vocal Fry has come forward as well with similar allegations involving a high school party.

Napolitano is wrong again, as per usual. He just likes Trump because Trump once mentioned putting him on the Supreme Court, which would obviously be another horrible Trump appointment.

It wasn’t just Trump hats or shirts, the MAGA demonstrators were carrying signs and wanted to go inside the Books-A-Million store where DeSantis was signing books. They were there to harrass DeSantis.

Books-A-Million is private property. Public Accomodation doesn’t mean you can stage a rally on private property. If it had been a BLM crowd, everyone would cheering DeSantis.
