Dozens of NYC workers file $250M suit seeking to end COVID vaccine mandate

Dozens of New York City employees who lost their jobs for not complying with the COVID-19 vaccine mandate have filed a $250 million lawsuit seeking to end the rule as the pandemic is winding down, new court papers show.

The group of 72 former employees are asking a judge to overturn the mandate given that politicians, including President Biden, Gov. Kathy Hochul, Sen. Chuck Schumer, have “all declared the pandemic is over,” according to a Bronx Supreme Court lawsuit from Thursday.

Many of the fired employees — from the NYPD, FDNY, Department of Education, Department of Health and other agencies –worked for the city for over 20 years, still they “were ‘thrown to the curb’ and callously terminated,” the suit claims.

The city continues to enforce the mandate for public sector employees is “arbitrary and capricious,” given it has “been rescinded for virtually everyone else in New York City,” the filing charges.

The ex-workers “have been unemployed for over a year, and most have lost their homes or the ability to support their families,” the filing claims.

A Staten Island judge in October ordered city workers who were fired to be reinstated to their jobs finding that the health department’s Oct. 20, 2021 order for public workers to be vaccinated exceeded the DOH’s authority. That decision is currently being appealed.

Since it is NYC, what they should do is sue for back pay and current pay until they are eligible for full retirement benefits, including the city paying into their pensions and retirement plans.

I think that is fair. Plus it will p*ss off the taxpayers who will have to fund this.

I think that is fair. Plus it will p*ss off the taxpayers who will have to fund this.

We would think so.

But after 40 years of watching politics closely I have to wonder.

I have seen the people NY vote consistently Democrat and I have seen those Democrats studiously find new and more creative ways in which to spend taxpayer’s money.

The waste, fraud and abuse of the public treasury in NY has been disgusting to observe.

My only conclusion from these observations is that the people of NY believe that their government has inexhaustible supplies of money from which it can fund any and all possible projects, programs and schemes.

Their child like faith in their elected leaders is rather sad. Every time one of these government schemes fails they seem to just shrug it off and say, that’s okay, here try again, you can do it.

So, I just don’t see much likelihood that the taxpayer will get pissed. At least not to the point that there will be any shift in the political winds.

Does this fall under the state police power, delegated to the municipal level?

Not that anyone in NYS or NYC ever thought those governments would do such a dirty deed, ostensibly based on or justified by that power.
