Alec Baldwin charged with involuntary manslaughter in 'Rust' movie shooting

A New Mexico prosecutor on Thursday charged actor Alec Baldwin and others in the fatal shooting of cinematographer Halyna Hutchins during the filming of Western “Rust.”

District Attorney Mary Carmack-Altwies announced involuntary manslaughter charges against Baldwin and the film’s armorer after more than a year of investigation into the October 2021 shooting on a film set outside Santa Fe.

Assistant director David Halls has signed a plea agreement for the charge of negligent use of a deadly weapon, the prosecutor said in a statement.

“After a thorough review of the evidence and the laws of the state of New Mexico, I have determined that there is sufficient evidence to file criminal charges against Alec Baldwin and other members of the ‘Rust’ film crew,” Carmack-Altwies said.

They used the gun for target practice the night before. They did some recreational stuff after work.

This guy has a really good analysis of it. Basically Baldwin’s likely to get convicted since he aimed at someone and then lied about the trigger thing.

I don’t think he should get more than a record and some decent probation, it was mostly the armorer to me. But I’m just glad he got charged.

Apparently, crew members were using the cool replica antique weapons for target practice. A bullet may have been left in the gun from that or maybe accidentally loaded as live ammunition, blanks, and dummies were stored together. Extremely sloppy weapons handling. There were 13 producers and Baldwin had no role in managing the film. The real managers and the clowns practicing with the guns also bear some responsibility.

Baldwin was waving the gun around, deliberately fired it at them thinking it was blanks, or cocked and pointed it but didn’t mean to fire. It was extreme negligence, but probably not legally murder.

Exactly correct.

Others also are supposed to check, but its ultimately the responsibility of the armorer to ensure the safety and security, and chain of custody of all weapons on set. Thats their sole focus for being there.

It also doesn’t help she had a history of problems as an armorer. Her immediate prior film she was an armorer on, also had screwups by her.

the armorer should have walked off the job if she could not perform her essential safety tasks.

still, there does not seem to be any way to verify that the gun was loaded with a live round at the time of the handoff from the armorer to the AD.

this seems to imply that the AD made a deal with the DA in exchange for reduced charges. The most obvious thing the AD would have to offer is testimony as to who he got the gun from and what he did with it from that point on.

if this is the deal, then the testimony could be attacked by the armorer’s defense lawyer.

so it seems possible that the case against the armorer is not airtight, to the point that it won’t hold up well in cross examination. if so, everyone is probably aware of this, the armorer is charged only for relatively superficial reasons, and she will skate.

Exactly. When Baldwin was handed the gun it was THEN his responsibility to
pause, double check the bullets to insure there were blanks in the gun, not
live rounds. And not depend on what someone told him.

Maybe, but pointing a gun that is capable of firing real bullets at another person is something that all of us should learn not to do from a very early age. Even if you feel you are 100% confident the gun is unloaded.

I mentioned here before that I never bought cap guns or any other kind of toy gun for my children when they were small. Not that I'm anti-gun, but because I don't want bad habits to form. There should be nothing "fun" about pointing a gun at anybody, even if it's a cap gun. I would much rather get my children a BB gun and teach them to handle it properly from the beginning.

When I was in the Marines, it was ingrained in us to never point a gun at something unless we planned to kill it. Even earlier, in the Boy Scouts, we learned not to ever point a gun at somebody.

It just seems so odd that a middle aged man would do something so stupid and reckless.

What’s strange to me is they didn’t use a gun that could only shoot blanks. I have one of those. It has an obstruction in the barrel so if someone shot a real bullet with that gun, the barrel would probably burst. But smoke can pass through the barrel like a real gun. Using a real gun was just asking for trouble.

That was Baldwin’s call, as the EP. He may have been rushed or didn’t want to fly in prop guns.

Baldwin should not be charged for not checking the gun. Actors are NEVER supposed to do that; that duty always falls to the armorer and his/her team. If an actor does anything with the firearm that isn’t called for in the script, the armorer should immediately take the gun, recheck it, then hand it back - with instructions to simply follow the script. According to what we currently know, Baldwin wasn’t supposed to squeeze the trigger in this particular scene, but he obviously did. That will have to be answered.

It sounds the opposite of everything the average person is taught about firearms, but on a movie set that’s how it works. There is a clear chain of command for the handling of firearms on a set. The armorer will also have much to answer for.

NOT TRUE.

In the FUTURE, not yet. If he had been charged, he would have been arrested.

When he is actually arrested, he should be denied bail as he has been shown to be a DANGER to the community and a flight risk.

His position as an actor does not change his responsibility under the law. My understanding is that, if you did not see the gun being checked itself, to protect yourself from liability, you need to do a run-check yourself.

He didn’t do that. All the conservative actors have said they themselves do their own gun checks, so he’s not free from obligations they themselves obey.
