Man arrested after killing 24-year-old trying to steal his car, Missouri cops say

An Illinois man has been arrested in the fatal shooting of a 24-year-old outside a Missouri gas station, police say.

The fatal shooting happened around 2:10 a.m. on Jan. 7 in the parking lot of a Conoco gas station, the St. Louis Metropolitan Police Department said.

Surveillance footage showed Jesse Lopez was trying to steal a car belonging to Brett Kress, when Kress shot at him, KSDK reported, citing a probable cause statement. Kress, from Sauget, Illinois, chased after Lopez and shot him three times, according to KSDK.

Officers found Lopez unconscious and not breathing. He was pronounced dead at the scene, police said.

Police in St. Charles County, which neighbors St. Louis County, discovered a “suspicious vehicle” on Tuesday, Jan. 17, that officers determined belonged to Kress, KMOV reported. He was captured nearby hiding in a shed of a mobile home park, according to the TV station.

Kress, 26, was charged with second-degree murder and armed criminal action, St. Louis police said.

Missouri law states that a person can use deadly force for self-defense but not to protect one’s property.

A person who uses deadly force must “prove he or she reasonably believed physical or deadly force was necessary to protect him or herself,” the law states.

Maybe Kress was trying to shoot the perp in the leg, but kept missing; thus, trying again and again.

Theft either by force or the actions of opportunity... must be met with deadly force or the threat of deadly force.

Nobody gets a pass that attempts to steal another persons property. The consequences must be inhibitory. A response of DEADLY force serves as a deterrent to anyone who might turn opportunity into action.

Missouri obviously protects the criminals behavior... and not the justified behavior of the victim,

Jury nullification. People who value law & order should never, ever ignore a jury summons, you never know when you can save an innocent person from persecution.

Same I heard about Michigan. On WJR a discussion a few years ago led to the giggling moron lawyer laughing (!) about how in MI you cannot protect yourself in a carjacking and the female host said "But a lot of our stories have said the driver and sometimes' their child were killed by the carjacker" and the lawyer said "Still you go to prison if you shoot the carjacker. It's protection of property." She was fuming and said "Well I want to know who the jackasses in the Legislature are who pass idiotic laws like that."

Her first making of a connection between elections and consequences.

Maybe shoot your tires out, then the thief can’t take off with your car. It might cost you a few bucks but you could probably start a go-fund-me and collect the money you’d need for the new tires. And you’d have new tires.

Still, I have to wonder, if everyone took this action against property theft, would the rate of property theft go down, or would the murder rate of persons other than thieves go up, as thieves became better armed and more aware of the risk?

The latter is probably why we have such laws. It is not necessarily a net gain for society to have vigilante justice, although I’m not entirely opposed to the concept either. If you figure that law enforcement’s response to property crime is likely to be useless then you’re the last chance to dispense justice.

Failed the Shoot - Don’t Shoot test.
It is pretty universal that you cannot keep shooting once the thug is no longer an immediate threat.
First offense so hopefully a light sentence, probation sounds right.
