It’s still asking the government for permission to exercise a right. The 2nd applies to all state governments as well as the federal gov. Not just some. (as explicitly prohibiting the infringement thereof.)

This past the House years ago, and McConnell wouldn’t allow it to come up for a vote in the Senate.
