And since the Democrats are never going to allow any bills to pass which they do not like, the Republicans need to reply in kind.
Another two years of government deadlock would be good for us.

It’s still asking the government for permission to exercise a right. The 2nd applies to all state governments as well as the federal gov. Not just some. (as explicitly prohibiting the infringement thereof.)
