State, Biden Admin set to clash on immigration policies in federal court (FL)

TALLAHASSEE — Amid a fierce national debate about immigration issues, Florida next week will try to convince a U.S. district judge that the Biden administration is violating federal laws through policies that lead to releasing undocumented immigrants.

Pensacola-based U.S. District Judge T. Kent Wetherell is scheduled to begin a trial Monday in a lawsuit that Florida Attorney General Ashley Moody filed against the Biden administration in 2021.

Florida contends that the administration’s policies result in undocumented immigrants flowing into the state, increasing costs for services such as prisons, schools and health care. Moody also argues that undocumented immigrants cause public-safety problems, such as bringing deadly fentanyl into Florida.

“These policies harm Florida,” attorneys in Moody’s office wrote in an amended version of the lawsuit, filed in August. “The Biden administration is releasing tens of thousands of migrants at the border every month. Many of these migrants are arriving or will arrive in Florida, harming the state’s quasi-sovereign interests and forcing it to incur millions of dollars in expenses.”

In the lawsuit, Florida has alleged that the Biden administration is “systematically violating” federal laws by releasing migrants who are required to be detained. In part, it has alleged the federal government has enacted a “non-detention” policy and violated a law known as the Administrative Procedure Act.

The state also has challenged the use of what is dubbed the Parole Plus Alternatives to Detention, or Parole+ATD, policy, which Justice Department attorneys described in the October court document as providing guidance on how immigration officers can use “discretionary parole authority” in certain circumstances to release undocumented immigrants.

The Justice Department has argued that Florida does not have legal standing to pursue the lawsuit and has not proven that it has been injured by the federal government’s actions.

Florida and other states are being invaded.

The Constitution specifically requires the federal government to fend off invasions upon state request.

If necessary, the court should hold Biden in a court detention cell until he performs his duty.

How can Florida not have standing? Florida has to provide translation services in hospitals and courtrooms and education to the “migrant” children. Plus arrests, public defenders and prisons should any of the “migrants” break the law yet again. FedGov can’t just say they’re not going to follow the law and make third parties pay for their inaction.

Clearly Florida is being harmed by the Biden administration’s inaction.

Combine The constitution, and federal Immigration section 8 law and you have no justification for anyone or any thing that lets illegals enter or stay in this country. And court that that rules differently is corrupt. Which appears to be most of them.

Massive, long-term illegal alien invasion. Just one of the many, many fronts where our nation finds itself under attack, aided and abetted by our own central government. And yet another front where DeSantis and his team is not just defending, but going on the offensive. You cannot win conflicts if all you play is defense. And far too many states' governments aren't even doing that.

By all rights, Biden should be arrested and physically dragged from the White House for the crime of being a leader within the cartel!

He is allowing deadly drugs and potentially dangerous foreign criminals to operate freely in our country.
How about child trafficking?

Speaking of children ... I see potential criminal warrants of manslaughter stemming from the death’s caused by fentanyl or the drownings in the rivers the illegals are using to come into the U.S.

The guy outted himself as an extortionist even before being illegally being put in office by the “intelligence” community, and media!

If the Feds are arguing that Florida cannot prove damages, then the Feds should have no problem if Florida denied all services to illegals.
