Judge tosses out lawsuit filed by Mark Finchem challenging election results
KOLD News 13 ^ | December 16, 2022

A Maricopa County Superior Court judge tossed a lawsuit on Friday filed by former GOP candidates Mark Finchem and Jeff Zink that challenges the results of November’s general election. Judge Melissa Iyer Julian dismissed the lawsuit with prejudice, which means it cannot be filed again. The judge also confirmed Adrian Fontes won the election and is the secretary of state-elect for Arizona.

Finchem, who ran for secretary of state, and Zink, a former candidate in Congressional District 3, filed a lawsuit on Dec. 9 to overturn the results of the election. The lawsuit claimed that current Secretary of State Katie Hobbs abused her power by failing to have tabulation machines properly certified and for threatening the boards of supervisors in Mohave and Cochise counties with criminal charges if they didn’t certify the election.

The lawsuit also alleged Hobbs should have recused herself from her position as secretary of state since she was running for governor. The lawsuit asked for an inspection of some mail-in ballots to compare signatures and compare “duplicate” ballots, especially for ballots in Congressional District 3. Zink was later taken off the lawsuit.

On Tuesday morning, during a court hearing to show cause, the Secretary of State’s Office said they would be filing a motion to dismiss the suit, calling the claims “baseless” and “sanctionable.” That’s when the judge scheduled Friday morning’s hearing. With the dismissal, Hobbs and Fontes have 10 days to file a motion for sanctions, which could mean they could force Finchem and Zink to pay the lawyer fees.

Nothing surprising here even though its very wrong on many levels. It will be appealed.

"Dropped A Deuce" Douchey appointed her in 2019.

Pyrrhic victory which will be outshined by Kari Lake’s suit which will include all of the candidates. Judge Peterson allowed Lake to have the ballots from Maricopa County to examine.

This judge is a totally lightweight Ducey appointment with past sum experience in family court. I hope Finchem has another move in mind.

The AZ GOP sent out a voter guide. Out of 47 judicial races, they only rejected 7 jurists (not to retain.)

I am going to start following my brother’s advice and vote no to retain in all future judicial races, rather than giving them a clear lane to victory.

These “judges” all appear to be okay with voter fraud. That’s sad.

I can acknowledge some leftist hack judge in someplace like Michigan or Pennsylvania. Don’t agree with it, but things are what they are.

Maricopa County, Arizona…..Nope

For one, when Title 42 ends next week, Arizona is gonna to be overrun with illegals. And they will start filling up hospitals and clinics all over the state. Does this judge have a special place to go? I don’t think so.

Arizona has been putting those containers on the wall for quite some time and now, it’s being sued to remove them. Right before a human tsunami hits the border.

Common sense, one could think, would look at the big picture and see where this is headed.

Very few will be immune from what is going to happen and this judge ain’t one of them. She might think she is, but she isn’t.

This election, I voted no on all judges. I want turnover often even if a good judge is lost.

I wish I had too, in hindsight.

I was working out of state and had to have my ballot mailed to me, and then I had to mail it back to my brother to hand carry to City Hall.

I was out of touch with the candidates and used an AZ GOP voter guide. Slaps forehead.

Fontes is such a reptile. He was the Maricopa County Recorder in 2018, when all the sleazy fraud started. I was happy to see Richer win that slot in 2020. But he is just a Dem puppet. Sad to see Arizona sink beneath the corruption.

This is a repeat of what the corrupt courts did to Trump in 2020 by squelching all legal challenges to results. Then the left used the failed court challenges to prove there was no evidence of election fraud. Diabolical.
