So true. To me a lot of this is just keeping the “ possibility” open to paint him as a criminal.
The Republicans can offset this by really going after the “ Big Guy” in a similar manner even if he’s not removed from office.
Paint the Dems, as Musk is doing as only intererested in power and control by utilizing the media and big tech to suppress otherwise damaging information.

Only if the prosecution can prove - beyond a reasonable doubt - that the 2020 election was fair and honest.
That same logic applies to the recent seditious conspiracy convictions.
There is NO sedition [government overthrow] if the election was fraudulent.
Job One for the prosecution in January 06 sedition and criminal liability cases is to prove the 2020 election was NOT fraudulent.
The prosecution CANNOT prove that.

I am absolutely convinced that DJT will be indicted/charged by an individual or body that ultimately answers to Washington,Albany or Atlanta. There's no downside...no negative consequences...for the person or persons responsible and he/she/they knows/know that it will knock him out of serious contention for '24.
Also,those responsible could set them up for a huge book deal.
