A man accused of killing a California gas station clerk during a "botched" robbery will not face a murder charge because the victim had opened fire on the suspect despite his life not being in danger, officials said Thursday.
James Williams, 36, was killed during an early Saturday morning gunfight with Ronald Jackson Jr., 20, at a Chevron in Antioch, Fox San Francisco reported.
The Antioch Police Department said a gas station employee called to report a person had been shot at the Extra Mile mini-mart just after 2 a.m. When officers arrived, they found a man with a gunshot wound to the head inside the store.
"Officers at the scene were able to determine that the victim was an employee-clerk at the service station and was held-up at gunpoint during what appears to be a 'botched robbery,'" a police statement said.
Williams was working inside the store when he was confronted by two suspects, one of whom was identified as Jackson, who was allegedly armed with a gun. Williams then pulled out his own weapon.
Jackson allegedly ran out of the store, while dropping cigar packages, and was shot. Williams kept firing as Jackson was on the ground before Jackson allegedly returned fire and killed him, the news report said.
"He didn't deserve this, and he was such a good guy, family man," Annette Matamoroz, Williams' girlfriend and co-worker who was in the store when he was killed, told the news outlet.
Jackson was not charged with murder because under the law, the killing could be considered self-defense, authorities said. The Contra Costa County District Attorney's Office said Williams pursued Jackson despite the threat of bodily harm or injury had subsided.

It seems obvious to me he was under a deadly threat because the robbery suspect killed him.
At the minimum, the suspect could be charged with felony murder, because he was voluntarily involved in a felony which resulted in someone's death.
Would James be “of color” by any chance?
Yes, James Williams, the clerk, was a black dude.
And while I can't find a photo, I'd suspect that the murderous criminal, Ronald Jackson, is also black.

This garbage will continue as long as it is just prols being killed by armed criminals. It will only stop when the armed criminals kill one of the elites, then all hell will break loose. The elites have utter contempt for the prols.
George Zimmerman was on his back having his head smashed into the edge of the sidewalk and being pounded MMA style when he and his assailant started trying to grab the gun George kept in his pocket to protect himself from pit bulls. The gun discharged, killing the assailant. Would this DA refrain from charging Zimmerman criminally?
Under the felony murder rule, a person participating in a felony is criminally responsible for any death that results from the commission of the felony, no matter how indirectly. If the clerk had shot himself by accident while resisting, even if his accomplice had shot and killed himself by accident in the commission of the felony, he could be charged with murder. This is an outrage without basis in law or common sense.

Sadly, too often, violent criminals escape justice.

That makes sense, and was my first thought. But this is California, where a theft of less than $950 isn’t really a theft at all. So I’m not really surprised by the DA’s actions here.

This is a deep deep blue area so the DA fits right in - protecting the rights of criminals over law-abiding citizens, refusing to charge or jail them no matter how heinous the crime.
This is exactly what they voted for.

The robber fled the scene thus removing the threat. The clerk chased him outside shooting with the intent to kill the robber.
Need to see a video.
