Liberal Justice Elena Kagan on Friday expressed hope that her colleagues on the conservative-dominated U.S. Supreme Court could get back to finding "common ground," saying it risked looking political by continuing to overturn legal precedents.
Speaking at an event at the University of Pennsylvania, Kagan did not explicitly reference the Supreme Court's decision in June to overturn the landmark 1973 Roe v. Wade ruling that legalized abortion nationwide.
But Kagan, who dissented from that decision powered by the court's conservative majority, argued that judges and justices should be "humble" and respect past precedents interpreting laws and rights that people build their lives around.
"If you give people a right, and then you take the right away, well, in the meantime they've understood their lives in a different kind of way," Kagan said during a discussion with UPenn President M. Elizabeth Magill. "So law should be stable."

Try having common ground rules, such as not leaking draft opinions, not doxing justices or attempting to kill them, and not inviting nut cases into the Senate gallery to disrupt confirmation hearings, or inventing 11th hour fake allegations during confirmation hearings, and finding and prosecuting the draft opinion leaker(s). There are nine justices on the Supreme Court to have honest, enlightened discussions of their respective differences of opinion, NOT to “find common ground”!
There was no common ground in any of the really vile decisions of SCOTUS, not Dred Scott, nor Roe v. Wade, nor Plessy vs. Ferguson. Thank G-d for fearless dissent.
The SCOTUS has been legislating from the bench for so long At least half of them believe that’s their job.

Quite true. The media pretend otherwise, but if you look at all cases heard over a term, it's obvious that they agree on expanding the police state more than not.
Nothing in the Constitution gave Scotus the power to declare rights.

If kagan can’t rule by what the law actually says, maybe she should resign?
In fact, We the People per the Ninth Amendment put government on notice. We the People and not courts declare our rights.
