Supreme Court leaves ban on bump stocks in place – again

The Supreme Court declined Monday to consider the latest challenge to a federal ban on bump stocks, keeping in place the prohibition on devices that essentially allow shooters to fire semiautomatic rifles continuously with one pull of the trigger.

By declining to grant an appeal, the justices not only avoided taking up a gun-related issue, they also sidestepped the latest challenge to the so-called administrative state.

Under then-President Donald Trump, the Bureau of Alcohol, Tobacco, Firearms and Explosives banned bump stock devices in 2019. Trump had ordered a review of the devices after a mass shooting in 2017 in Las Vegas, in which a shooter armed with semiautomatic weapons and bump stock devices opened fire from his hotel suite onto outdoor concertgoers, killing 58 people and wounding hundreds of others.

At issue in the dispute was whether the ATF had exceeded its authority in 2018 by reclassifying bump stocks as machine guns under the National Firearms Act.

Challengers framed their appeal as a separation of powers dispute, arguing that a federal agency – unaccountable to the public – lacked the authority to issue a final rule banning the devices.

It is stupid, but so is anyone who actually wastes ammo using a “bump stock” while pretending that they are firing an actual machine gun. But not to worry the fantasy warriors may soon get the opportunity to get a free expense paid trip to a war zone in Eastern Europe in winter. Fun, fun, fun!

Yep - although I never had a bump stock nor did I ever want one it was still an infringement. I figure the tax thing cost me an extra 12K a year.

The pistol brace issue is a better supported case. Either should raise the same issue of an unelected agency changing or creating law.

Every time they wuss out like this they cripple their own words in West Virginia v. EPA.

No point in saying that agencies can’t willy-nilly issue rules
where Congress should act if they then let FedGov do just that. This goes doubly for agencies that shouldn’t even exist like ATF.

Heck, I knew a guy who could just hold a semi-auto AK right and basically pull the rifle into his index finger, recoil would take it off the finger and allow the trigger group to reset as normal, steady forward pressure on the forestock with the off hand would pull it forward to fire again, etc.

He’d empty a 30 round mag in a few seconds.

I would not hold my breath. The trigger mods allow better control of the gun, but it is easy to see that they will soon be illegal as well because of the intent. Anything that allows people to fire cartridges faster than they can pull a normal trigger is probably not going to be allowed in the long run. The Supreme Court is not going to do anything about these future bans either. If wasting ammo using these devices gets you off... then enjoy them while you can.

It is very easy to bump fire many rifles, especially AKs without a special stock. The stocks make the technique slightly easier and slightly safer.

I have an old VCR tape of a 1980s Supreme Court case on full auto rifles showing how to make a semi into a full auto using common household items. String, rubber bands, piano wire and many other methods.

Again it is a VCR tape. Haven’t seen a player for it that worked in years.

Where did he raise income taxes? You mean by reducing what over taxed states can deduct on their federal taxes? That’s on them for putting up with high taxation in their state.
