Madman seen smashing NYC McDonald’s with an ax released without bail

An accused jilted madman who flew into an ax-wielding rage at a Lower East Side McDonald’s was released without bail at his arraignment, authorities said Sunday.

Michael Palacios, 31, who allegedly grabbed an ax and trashed the Delancey Street fast-food joint in a fit early Friday, was arraigned on fourth-degree criminal-mischief and possession-of-weapons charges hours later and freed, the Manhattan District Attorney’s Office said.

Neither charge is eligible for bail under the state’s lenient criminal-justice reforms.

According to a criminal complaint filed in the case, Palacios slammed two tables and a plate-glass partition during the early-morning rampage.

Palacios also told cops, “I have a pocket knife in my bike,” according to the complaint.

A witness to the wild caught-on-video incident said Palacios went off when a woman at the restaurant “rejected” him after he continually tried to talk to her.

In New York, unlike every other state, judges can only use bail as a tool to ensure that defendants return to court. They cannot take into consideration the harm a defendant may pose to others. By the time the 2019 changes went into effect, New York City had already seen a marked decline in the use of cash bail.

Dr. Marie VanNostrand, a scholar of criminal justice systems who has studied New York City’s data, said that she has seen an increase in offenses among people who had been released to await trial after being charged with violent felonies.

Judges may set bail for most of these crimes, but their decisions can be based only on ensuring that the defendant returns to court.

Data from the Criminal Justice Agency shows that the number of people who were facing violent felony charges, were released to await trial and then were charged with committing new violent felonies has risen to 320 in the first quarter of 2021, compared with 259 in 2020 and 160 in 2019.

Many law enforcement officials have tied the release of such defendants to the recent uptick in shootings and killings across the state.

Shows some guys beating up on him while he just sits there, then gets his hatchet out and busts up the place. No explanation why those guys were beating him or him getting rejected by a woman he was hitting on.

Everyone in the restaurant joins a lawsuit for emotional distress. For the next ten years, this boy then has half of everything he makes, taken from his SSI, whatever, to pay the court-ordered damages to the visitors and to McDonalds.

Furthermore, he is locked in stocks for a day in front of the McDonalds, where he is to announce his crime every five minutes.

And this story, along with countless others like it, is why the GOP candidates on Nov 8th need to focus on-—

1. Crime
2. Illegal immigrants
3. Inflation

Even the low information voter can understand the above three issues.

I saw the video. He did WAY more than just trash the McDonalds. He actually swiped at people with the axe, punched a sitting man in the head knocking him off the chair, and was screaming at and threatening a woman.

And he gets released with no bail? I’ll never go to NY again.
