Chrystul Kizer is headed to trial for allegedly shooting her sex trafficker, Randall Volar III on June 5, 2018. He was being investigated at the time for serious crimes including sexual assault of children and child porn. The Kenosha DA did not charge him with a crime. We told you how Mike Graveley’s office was responsible, in part for Volar’s death by dragging its feet with the investigation after Kenosha Police recommended many felonies and had mountains of evidence against him.

Kizer wanted to mount an affirmative defense in this case to tell the jurors that she killed Volar because of her being trafficked. The Trial Judge, The Honorable David Wilk denied the use of this defense. Kizer appealed and the court of appeals and was successful. DA Graveley appealed to the Supreme Court and Kizer prevailed again. Kizer can now use the affirmative defense. Today’s court hearing was routine and some deadlines for motions were set and there will be a motion hearing on January 17 of next year. Kizer was greeted by a group of women wearing all red who brought Kizer some well wishes cards. When asked by KCE how she was feeling, Kizer replied with “tired.”

The Judge and the prosecutor tried to deny her a self defense plea.

She appealed. She will be able to use an affirmative self defense argument.

This is the same Prosecutor who went after Kyle Rittenhouse.

Under what circumstances is it up to a judge to deny certain defenses? Seems to be a First Amendment violation at least, among other problems.

There are people...typically men...who do,in fact, very seriously violate the basic human rights of others by forcing them to engage in sexual activities against their will. Any such person has the right to resist such mistreatment.

In this woman's case let her present her evidence. And hopefully her lawyers will be allowed to bring up any criminal history the dead guy might have had...particularly convictions.

It is complex. Not everything is allowed into a court.

One of a Judges primary duties is to only allow what is legally allowed.

In this case, the Supreme Court disagreed with the lower courts.

How can an affirmative defense not be allowed? This seems to be a gross miscarriage of justice.

That’s what I’m sitting here thinking. She went Paul Kersey on her sex trafficker, when the local officials were doing nothing?

Good.

Oh!

I didn't even notice that you misspelled it. :)

Actually, when I use a single word in quotes like that as a reply, I'm pouring all the disdain and dismissal into the word that I can, without actually using foul language, spitting or publicly relieving myself on the jurisdiction or person.

Thusly: "Associated Press", for example.

Saves on FR timeouts, for one thing.

Judicial malfeasance is my take on this.

She should have finished up on the associates of her sex trafficker - the local Legal operatives who are attacking her with their Clown Justice system.

Same ones who teamed up with the local Antifa to attack Kyle Rittenhouse, after he took out the trash littering their streets.
