Justice Dept. and Trump lawyers dispute how the Mar-A-Lago special master should work

Lawyers for former President Trump and the Justice Department laid bare significant differences over who should serve as an independent special master to review materials collected during the Aug. 8 court-authorized search of Trump's Mar-A-Lago club that turned up highly classified documents.
They also split over how the special master should go about the work of identifying possible priveleged information to be returned to Trump.
The parties submitted a joint filing late Friday night with the U.S. District Court for the Southern District of Florida ahead of a midnight deadline set by Judge Aileen Cannon.
The government has proposed two retired federal judges to serve as special master if their appeal fails: Barbara S. Jones, who served in the Southern District of New York and was appointed by Bill Clinton to the federal bench, and Thomas B. Griffith, a George W. Bush appointee who served on the federal district court in Washington D.C.
Trump's legal team proposed retired federal Judge Raymond J. Dearie who was appointed by Ronald Reagan to the Eastern District of New York, and who also served on the Foreign Intelligence Surveillance Court. Their second candidate is Paul Huck, Jr., a former partner at Jones Day and contributor to the Federalist Society who served in Florida state government under former Republican Govs. Charlie Crist — now a Democrat — and Rick Scott.

DOJ submitted a Clinton judge and a Bush Judge. Trump team submitted Dearie, a Reagan judge, and Huck, who has never been a judge, and will probably not be chosen because he has a history with Trump.

This is a joke. Do these agents even have appropriate authorization to see “classified” information? It sounds like anyone can see “top secret” stuff.

The article assumes as a fact something that is very much in dispute: whether documents marked classified were in fact classified or had been declassified by President Trump. The marking on a document is not determinative off this issue, which is why the “government” glosses over it.

The DOJ and FBI said Trump want cooperating.
Yet he had complied with legal subpoenas.

The DOJ and FBI are government agencies supposed to be non-partisan. Yet their partisan ship, lies, organized criminal behavior toward Trump is documented with him running in 2015.

The DOJ and FBI said that Flynn lied to them, yet they bragged how the set him up, and lied about his activities, and ignored every democrat who has done the same, yet bankrupted the man, destroyed his reputation, and likely interferes with his first legal team.

The DOJ and FBI have had more people investigating Trump longer than any criminal in the US or network of criminals. Yet, this far they have only ‘manufactured’ hearsay and lies.

The DOJ and FBI have repeatedly ‘leaked’ sensitive information when it suited their political purposes. These are NOT the actions of a law enforcement agency who is non-partisan.

The DOJ and FBI siezed attorney court privilege documents from Trumps home, and illegally shared them With Congress. They also confiscated medical records, which have absolutely NO legal value and are only used by Tyrants and Despots for political advantages.

Now, they want me to believe that Trump shouldn’t have a special master look at the seized records, or it should be another democrat operative…….. Only on NPR and MSNBC could they say that with a straight face.

Do Brennan and Clapper still have top secret clearance? Maybe they chose the “national secrets” approach not only because it’s easy to make it sound important to the ignorant , but also to avoid any oversight.

Yes, they do. Trump ordered dept. staff to pull their security clearances but unbeknownst to Pres. Trump, the defied his orders and never pulled them.

NPR did not claim that in this article. It's true that NPR did such a dishonest job on Hunter's laptop that their own employees called them out.

They may have been "highly classified" at one time, but context matters.

Perhaps the DOJ should submit one document (it believes indicates that Trump should not be in possession of every single document) to the judge for her examination.

If she feels that the DOJ does not have a case, the DOJ should ensure the Presidential Records Act has been fulfilled by making necessary copies for the National Archives and then return all the documents to Trump.

Perhaps Trump and the DOJ should each name a special master and they can work as a team.

The disputed documents (or team member summaries) can then be examined by the judge.

Why was that put in the Constitution?

I suspect because somebody like George Washington didn’t want the old-fashioned equivalent of Monday morning quarterbacking.

Only by having documentary evidence that supported his action can a President be safe from unwanted & unjustified politically motivated attacks.

It is both necessary and proper that a former President be able to retain such documents. Politics is among the most vicious of occupations.

The real tell is that the three judges are all NYC or DC based. That immediately raises fairness questions.

Trump should have proposed John Ratliff, a former Director of National Intelligence, and therefore eminently qualified. Retired judges will not necessarily know beans about national security and related paperwork.

Those who have a problem with Ratliff’s history as a Trump appointee can explain why that is a problem, but it’s fine for the Biden administration to allow the current Director of National Intelligence (a Biden political appointee) to comb through Trump’s documents.
