BILLINGS, Mont. (AP) — Montana health officials on Friday made permanent a rule that blocks transgender people from changing their birth certificates even if they undergo gender-confirmation surgery.
The move by Republican Gov. Greg Gianforte’s administration comes just days before a court will hear arguments over the legality of a similar rule that’s been in effect on an emergency basis since May. The ACLU of Montana has asked state Judge Michael Moses to strike down the emergency rule.
Moses in April had temporarily blocked a 2021 Montana law that made it difficult for transgender people to change their birth certificate.
The law said people had to have a “surgical procedure” before they could change the sex listed on their birth certificate. Gianforte’s administration then went further and blocked changes to birth certificates even after surgery.
Over the last several years, conservative legislators in numerous states have sought to limit the rights of transgender people.
Only Tennessee, Oklahoma and West Virginia have similar sweeping prohibitions against birth certificate changes, advocates for transgender rights say. Bans in Idaho and Ohio were struck down in 2020.
Transgender plaintiffs represented by the ACLU of Montana have said a birth certificate that doesn’t match their gender identity puts them at risk of embarrassment, discrimination, harassment or violence if they are asked to provide their birth certificate.

Birth certificates are literally statements of fact. Not opinion, not a thought in ones head. Facts only.
its dangerous not to know what a person’s true biology is. And NOTHING on earth should change your birth certificate at birth, that would be tampering with public records

Easy. Use the term “Born As” on all birth certificates. Done.
Call it “Science”.
I respect anyone who declares their sex at birth or at the age of 18. I respect no one who identifies their child as a certain sex other than what is revealed on their Birth Cirtificate.

We need a law because twisted hafwits can’t or won’t say whether our babies are male or female.
The state should make a statement that unless or until you can submit genetic proof that you have changed your sex, your birth certificate will not be changed.
Good for them.
Liberals like to say that, “A gender is assigned at birth”. No, you sex in recorded at birth.

Are there any limits on how many times birth certificates can be updated in other states?

There was a man that went to the hospital complaining of abdominal pain. The doctors checked him out and couldn’t figure out what was wrong. I think they told him it was gas and take something for it.
Later that day the “man” had a miscarriage.

And anything other than birth gender assigned at any time is insane.
We live in a culture that says people are assigned male or female at birth. We are lost.
